does this infringe their human rights as in right to free speech and how much can the sue the judge for.

You just can't use any electronic device in court, mobile, camera, recording device etc. Anything that can record proceedings basically. Ie, nearly all mobile phones can do all the above and there are signs at all courts telling "clients" to turn them off.
It's more abour respect than anything, I mean, FFS! Whilst in the dock, taking a call?

"use", or "hold", sounds like its got to be proven it was being used rather than just held, is that not the law with driving and phones..???

like the comment said, its about time people took notice. imagine how many people might get seen by car drivers if they wern't talking on mobiles for example?
People never think of consiquences of their actions. Things like this might help them a little.
