View Full Version : Crash Test Dummy - Me!
Well looks like I have finally lost my crashing motorbikes virginity!!!
Had a spill last Tuesday morning on my way to a course. Some dosy bint pulled out on me and although I managed to brake/swerve to avoid her I lost the bike and ended up with me and the bike sliding down the road. The road was wet but luckily I was only doing about 10-15 miles per hour.
I did walk away from it so I consider myself a very lucky boy!! Just sustained some minor injuries:
Both thumbs broken.
2 fingers broken.
Badly bruised hip
Killer headache for 2 days.
Worst of all bruised ego.
My already injured mediate ligament is also much worse since.......
The SV came off a bit better though:
Broken gear lever
Scarred clutch lever
Bent, but working radiator
Broken wing mirror
Broken front indictor
Minor fairing scuff
I also need a new lid as it smacked the floor quite hard and my water proofs have a few holes in the outer layer due to the slide.
Now the police say that I cannot claim as I didn't hit her, but she definitely caused the accident. That can't be right - can it?

that's ********, tell your insurers she caused it, although unless you have witnesses she'll say you just fell over and i doubt you'll win...
next time ride into her, then you have evidence:mrgreen:

Sorry to hear this :( rubbish. Did she stop at all? Did you get any witnesses ? I think even the police will find it hard to believe you threw the bike downa straight road for fun

After my off 4 weeks ago, know how you feel, broke bone in my hand is just about bearable now, Bloke that puled out in front of me will pay for the damage but am having trouble getting the bits at the moment because he wants to keep it off the insurence, get your insurence to take it forward if you get 50-50 at least you'll get something back
There were witnesses, one of which was a biker, another a cyclist I cannot get their details from the police due to Data protection!!!
I'm only TPFT so cannot claim for any damage to my bike, but will my legal assist help?
I got a friend to do a Kwak style repair to the gear lever (bolt, two nuts and a bit of rubber pipe) so it can be riden. Then I am going to do the minimal amount to the bike until I can find out a bit more.

two bits of good news, if you have witnesses tell the police you're not happy that someone has causded an accident, make a huge scene if they try to fob you off, don't let it go
other bit is that if she caused the accident, her insurers pay for the damage to YOUR bike, because YOU are the 3rd party refered to on her insurance

AS TLW posted make a fuss to the police it was an accident and they are obliged to give you the other parties details if it was reported to them

You can request that the police ask the cyclist if they mind having their details passed on to you. That decision lies with the cyclist, not the police.
The DPA does not prevent them from speaking to the cyclist about this.
Get a good solicitor, your ins co will give you details.

Utter b0ll0xs about the '..because you didn't hit her, it's not her fault' malarky.. It was her lack of care and undue attention to the road that caused the accident in the first place. Get on the blower to the police and start quoting the highway code. My accident 5/6yrs ago sounds exactly like that. A guy pulls out in front of me from a side street and due to my evasive reaction, there was only one outcome and that was the pavement surfing option.
Keep at it, don't let it go otherwise you'll be the one paying for it all..
Luckily I managed to get a decent pay-out as the guy who caused my accident decided to do a runner whilst i was in the middle of the road thinking about the cost of replacement fairings..

How does this affect FLM training?
FLM traing has been poor since before the accident, but it won't help. Going to leave it this week and try and start fresh next week.
I have just managed to speak to Carole Nash who are going to try and persue this using legal assist to reclaim all my costs. Makes me really glad I chose them over some of the cheaper options. They came up trumps for me previously in a car, so lets hope they can do it again.
I would say fingers crossed but that's not yet possible.

Thats who i was insured with and id deffo recommend their legal aid part! doing a good job with my accident claim so far.

kral, this is ********! get onto rider support services and get a claim going. it sounds to me like the police are being lazy useless people who play with themselves on a daily basis. just because you didnt hit the car doesnt mean shes not at fault. get a claim going and put in a formal complaint against plod!

The good news:
Spoke to the solicitors earlier this afternoon, so Carole Nash didn't hang about on this, so that is in motion and quicker than I thought. It just proves that you get what you pay for.
The bad news:
One of the officers who attended the accident called me this evening as I have been trying to get the details with no joy. He again repeated that as far as they were concerned there were no other vehicles involved, even though the car caused my evasive action. He then said he couldn't give me the details due to this, when I asked for the witnesses names he again declined saying it was being passed to the traffic division who would decide what to do.
As a parting shot I asked for her reg number at the very least to which he replied 'I'll have to speak to my skipper and get back to you!'.
I'M STILL WAITING!!!!!!
Oh and one more nugget, he told me that the CAD number (not sure what that is) that I have and have been given by two seperate sources using my Reg no is incorrect and gave me a different one. WTF?
Does anyone know a) what is a CAD number? b) Can one incident have numerous CAD numbers? c) If so why?

ohh crap! sorry to hear your news, by the way I HATE INSURANCE COMPANYS! good luck.
Even moe bad news, I went for a check up at the hospital and I have another broken bone - the scaphoid, which is a smallish bone in your arm but as it has a particularly delicate blood supply can be nasty and the bone pften dies having to be removed by way of an operation.
I am now in plaster!

That was about the only carpal bone I didn't break, lucky they found it though, if that one has to be set back in place by surgery then its got a good chance of working. If you hadn't noticed it then theres a big chance of needing a new wrist later in life.

Kev, sounds like the police down there are a bunch of lazy to$$ers m8 :(
When I was knocked off whislt filtering, I was given the registration, drivers name AND HIS ADDRESS purely so that I could pass the details onto my insurance.
Just because you didn't hit them doesn't mean that "no other vehicles were involved" as in your opinion it was the car driver who caused the accident.
However, if you don't get any joy with the police then just give ALL the details (CAD numbers) to your insurers who CAN get the information from the police reports. That what I was told by the copper who phoned and spoke to me. He asked why my insurers weren't doing this, and I said, "Well quite ... I don't know the score ... and the accident claim form asks for these details, so I thought ...", and he just laughed and said "sounds like you're doing half the bloody work FOR your insurers because this is normally THEIR job".

I'm getting confused.......I had to attend my local fracture clinic this morning so that they can look after me as I am not local to where the accident happened. Anyway long story short, plaster has been removed after only 25 hours, I am told that they are not convinced it is broken, given a metal hand/wrist support thingy and told to appear back there in 2 weeks for X-Rays and a review???? WTF!!!!!
While I was in the clinic I met a guy who came off his bike at 70 mph when a van pulled out on him. He hit the van (also travelling at 70) and then slid down the road for 200 feet. Mind you he managed to only sustain shattered lower leg, dislocated shoulder and some ligiment/tendon damage to both hands and wrists. Lucky man to be alive, did make me feel like a tart though.
