View Full Version : Legal advice req'd: Sale of Goods Act & Gift Vouchers
Can any of the legal-beagles out there help with this one?
I bought some gift vouchers on Fri for a mates wedding. It was called off.
I've got £50 of vouchers that Ann Summers won't take back.
Legally are they obliged to?

buy your missus "the wave" they're £50 and she'll love you for it!
Before anyone starts getting ideas 2 of my housemates are ann summers reps so I get regular updates on new products! I also get to see what filth the girls I know have been buying!

Ahh - cheers, I was hoping that if there was no sign at the point of sale I might have gotten lucky. Blast.
Cheers anyways!
Why Ann Summers for a wedding? Thats a bit of a one-sided gift don't you think? At least with Curry's vouchers they can get that dvd player or part-pay for that 50" telly!

Hmm, Difficult one this. Legally I would say no as vouchers by their very nature are 'non transferable'. However if you have a receipt and you know the person that sold them to you AND you can prove that you aren't pulling a fast one ie trying to change vouchers given to you for cash, then I would appeal to the stores sense of goodwill and ask nicely.
If not then the sale of goods act is always a good one to quote. Threaten to write to their Head Office if they don't help you out.
Most important is be nice. Lose your rag and start ranting and you'll get nothing.
One final thought is to ask someone who is shopping in the store if they want to swap their cash for your vouchers! However, approaching complete strangers in an Ann Summers shop should probably be avoided!:batman:
Good Luck!

Why? How is the shop's refusal to refund a breach of the Act? I don't believe that it is a breach. There is nothing wrong with the vouchers, they match description and are of satisfactory quality. So what's the remedy? - there isn't one. The moral is - Dirk should have bought the vibrator;)

True, however your average miminum wage shop assistant doesn't know that.
Also 9 times out of 10 your head office will side with the customer even if no law has been broken ( I speak from personal experience) so your average Store Manager who doesnt give a crap about the company, probably earns a pittance for working 60 hours a week etc etc will get all jittery just at the mention of SOGA....and will do anything to make you go away.

The sop manager said it was shop policy not to give refunds - even when I mentioned that it was for a wedding present for a cancelled wedding. He gave me their head office number but Head office didnt' want to know their returns policy is I can return items for vouchers...I pointed out that I had vouchers already.....Automotons!

Then you're, ahem, screwed.
Selling them on would appear to be your only option, and in future always buy a present!

Yeah - the wedding was "hastily" arranged so I didnt' get much time to think about presents.....oh well. Wonder how my hosue mates will react when I give them a "rabbit" for Christmas.....it's the present that keeps on giving.
