View Full Version : Declined a job offer today :(

I have been looking for a permanent role for some time now and was offered a job at a company as their Change/ITIL Manager. Money was good and the whole benefits package so I accepted subj to contract

then the contract came and it was so binding that if I left them I would have to move country to get another job (without explaining about it to much). I negotiated for 3 days but nothing positive came out so I told them thanks but no thanks

feel a bit deflated now but I guess it's for the best :(

I thought these covenants in contracts were supposed to have been outlawed because you should be free to work wherever you want ... in placing too many covenants into employment contracts, you are denying a person a basic right to work (should they leave the company)?!

the contract was 5 pages long and 3,5 pages were Restraining clauses :(

There's always a way if the company decide they want to. Mine appear to be trying that with me now, in that none of the companies that have ever carried out some work for me can ever employ me, it's part of their contract with my employer. Bit sh*t if you ask me, considering who those companies are - a few multi-national companies that can't employ me now, at least on paper. Doubt it'll stand up to scrutiny.

they are a TV channel that sell things over the telly and I would be their working in their IT dept

Any contract cannot preclude you from earning a living once you have left the company. If they pay you for that time stated in your contract that you are precluded from working for any competitor (like three years severance pay if you cannot work for a competitor for three years) then they have the right to have it in the contract. But they must pay you if its in there.

If they are not willing to pay you for that time, the contract is non-enforceable.

The only proviso is that you have to "prove" that you at least tried to get employment in another sector before accepting the position for the competition. Uh Hu! :) about three cover letters would do it :)

Also, if any case is contested by your old employer, it's likely your new employer will cover the legal fees.

Phew! :) I got that from an Employment lawyer when I left my last contract.

Oh, and this is under EU law, which supercedes Uk law now.

there was no mention of pay for the time I wouldn't be able to work for a competitor

I am also starting my own business which is retail and they obviously consider it as a conflict of interest but anyone retailing anything would be a competitor to them since they have such a massive range

anyway for £35k it was not worth it!! maybe my own business grows rapidly and I make more than that in a years time, maybe I make a loss but at the end of the day I'm only 26 and don't see why I should have been tide down that much for an IT job.........it's not like I'll have access to their sales figures or any of those.
