I shouldn't think it's legal to carry cos it has a 15cm (6inches in old money ;)) blade

Shellywoozle
06-04-08, 12:28 PM
Not legal to carry about in public, blade is more than 3" and is lockable. Altho it is a sexy offensive weapon, it being sexy (or you for that matter) isn't a defense for carrying it :)

If ya want me to use my cuffs on ya then pop one in ya pocket and I will happily oblige....LOL.

People do carry them about innocently and other such knifes thinking its OK ... bless em !

northwind
06-04-08, 01:23 PM
If you're concerned about the legality you can take the edge off down to 3"- apparently locking blades aren't actually illegal, I always thought they were but it seems not.

Lock knives are classed as offensive weapons and carrying one is arrestable in England at least.

.. actually i know quite a few blokes that already have these in their tool boxes so I'm not sure of validity of that statement!!!... but your right the colours are very shiny and therefore deemed as "girly"...

but blue please dont pass on your own obvious shortcomings onto others ;)

with regards to whether or not you could be done with the blade on your person well I have always thought that if it's a lockable blade it doesnt matter whether it is shorter then 3". I was having this discussions with some of the other technitions the other day and we all said that outside work it's just not advisable to have them on us unless we have to transport our tools in which case they should be in the tool box that is locked.

OK, so I went and looked it up... The Prevention of Crime act outlawed carrying "offensive weapons" but the definition then was "as any article made or adapted for use to causing injury to the person, or intended by the person having it with him for such use. " whic was superceded by the CJA 99, section 139

"any article which has a blade or is sharply pointed, (including "a folding pocket knife if the cutting edge of its blade exceeds 7.62cm/3 inches)" is defined as an offensive weapon. But there's not a peep about locking. So it could come down to the interpretation of "folding", since a locked pocket knife won't fold, but if you unlock it it will.

Back over to you Bluepete! I'm really curious about this one, not saying you're wrong at all here, just wondering why there's a difference. My criminal law stuff was all scots law but I'm just checking out the CPS site here and doing a couple of wee case law checks

(FWIW I had my Opinel pocket knife examined at some length by a desk sergeant who really wanted to charge me with something, and though he was aware it would lock he gave up after measuring it.)

anna

Northy, lock knives are defined as offensive weapons "per se" and fall outside the bladed or sharply pointed article remit and the law relating to folding pocket knives.

Not sure if it's a stated case or just a seperate piece of law that defined them as such without Googling it up.

HTH,
Pete

Kylie... would it be wrong of me to say i liked the look of those then??? opps

northwind
06-04-08, 11:07 PM
Hmm, according to the PNLD "A lock knife is not an offensive weapon per se (because these knives were made with a specific purpose in mind and not as a weapon). However, possession of a lock knife in a public place without reasonable excuse is an offence."

But then...

http://www.bailii.org/ew/cases/EWCA/Crim/1998/385.html

"point of general public importance certified as follows:
'That the article 'a folding pocket knife' as mentioned in section 139(2) Criminal Justice Act 1988 as being an exemption subject to subsection (3) to the offence made by section 139(1) means a knife that has a blade that folds, whether or not it (the blade) is capable of being opened and locked into an open position and equally capable of being folded once the mechanism had been operated to unlock the blade.' "

Apparently 2007 Blackstones specifically stated that a locking knife isn't an offensive weapon per se, but I can't say that for sure, that's a second hand link.

So basically, Anna, we need you to go and get arrested so we can find out what happens :D

anna
06-04-08, 11:13 PM
