Just had this today, in the end we agreed a settlement prior to the case (as in, in the waiting room waiting to get the case heard!) - not as much money as I was claiming (the limit of small claims cases), but a reasonable amount, and a free (replacement) tracker.

I'm not going to openly name the tracker company now, if you want to know who it was feel free to PM and ask (and I'll probably give the name, but it's up to me ;)). I think given we've come to a settlement I'm happy with, it's not right to name them openly, even though there was nothing to say I couldn't.

Also they have changed the part of the system that was broken & whilst I was the only one affected (as far as I know) I appreciate the fact that they have made an effort to fix it given there were many other bikers out there who could have been put in my situation.

Anyway just wanted to say after 6 months of this dragging on (and I'm aware this is short for a court case!) I'm glad it's all done and dusted. :)

Oh well thats a reasonable outcome, nice of you to be good about it. I did think it was incredibly frustrating when it all happened initially, but I thought it was as much lame police for not being able to search through a few gardens that the tracker companies fault.

Yep agreed, the fact the police couldn't just ask to see in a few sheds to see which one it was did frustrate me too...I think it was because the owners could say no at that time, and getting a warrant would prove difficult as you couldn't just get a warrant for all the sheds, it would have to be a specific one. A pity but as you say, sorted out now :)

Thanks guys. gettin2dizzy - you mean, what was the original problem with the system (why it stopped working)? Yeah they know what that was, they have changed the system they used (was a third party system, still is, but a different third party) and I am assuming they took into account what happened (or why change!).

I think I could have actually handled being done for breaking and entering to recover a bike and figure out who had pinched it in the first place.

Glad you have a result in the end though.

DO u know if the tracker stays live all the time, so if a theive puts a battery back in the bike and rides it will it inform the tracker company?

Thing is, due to the circumstances, it'd have been done in front of the police, who aren't going to let you do that ;)

Yep, it would restart in full power mode, I can't remember off the top of my head if it would start sending signals though - I am pretty sure it wouldn't start up in any "I've been stolen" mode though. If it was moved or otherwise had the sensor set off it might do.

But, they aren't - weren't - gonna put a battery back in that bike ;) it wasn't really going to be rideable as they had no keys, and the tracker/alarm was wired into the loom, so too much hassle.

Actually I'm left with no insurance claim and this is for "unclaimed" losses I guess! (it's a significant portion of the value of the bike)

Yep no problem, not sure if there is much I can add though, as mentioned I don't want to try and dirty the name of this company as they do appear to have made a big effort to change what went wrong, so my experience may be completely different to yours...

Lol - to break for parts! The parts fetch a high premium, probably more than trying to sell a stolen bike anyway. Wheels, bodywork, suspension, and many other bits - all cost a lot, even on Ebay.

Given muffles has said the insurance company didn't rate the tracker, I would imagine that the police reports etc were enough to convince the insurance company to pay out for the bike.

The settlement for this I would imagine is mainly for aggrevation/stress caused by lack of access to the system (website was down whilst trying to track). Maybe a small part would be for any property damage not covered by the bike insurance. :confused:

You'd think ;) actually due to my circumstances (one other claim in last 3 years already, living in London) it didn't go like that. It's all in that other thread I think, so I'm being very brief, but I didn't claim because the cost to reinsure was more (try £7k! :o) than the payout for the bike. I believed the actions of the tracker company to be negligent - the system was brought down deliberately - hence the court case. In my situation I believed that the system not working significantly affected the outcome.

So, the settlement was for that...as I was claiming the cost of the bike (well, to the limit allowed in the small claims court). :)

Yeah £5000 is the limit in the small claims court, the settlement wasn't for that, but it was a significant enough portion of that, hence me being happy :)
