Hi guys, im after some advice if possible
I advertised my Daytona on Ebay last week and it was sold, the chap came and collected it on Saturday, but i recieved a rather angry email from him last night.
basicaly he is saying that:
the fairing is cracked in places
he got pulled over on the way home buy the police because the exhaust isnt legal
the forks are twisted
and the engine doesnt run right
now
ALL the scratches, scuffs etc to the fairings were in photobucket, which there was a link to on the Ebay advert
The Exhaust has passed multiple MOT's, and the forks being twisted is rubbish, it was MOT'ed in its present condition, if they were twisted or bent surely it would have failed
and i told him at the time, he needs to get the CO reset as the engine bottoms out a little (stalls as the engine idle is too low) plus ive not run the bike for alost 7 months so it needs a good run.
plus he came and looked over the bike for a good hour after the end of the auction, and if he wasnt happy with it then, he could have said so
now he paid me a deposit directly via paypal, not through the Ebay checkout system thingy, and the rest in cash on collection. so im pretty sure as far as Ebay know he hasnt paid yet.
Im just wondering where i stand. As i dont want any comeback from Ebay type thing

I would suggest in that case it is sold as seen. Worst that can happen is bad feedback on ebay, if the ad was accurate and he only paid on collection. tough. I'm not legal expert however...

You've got the money and sold him the bike fairly.
What are you worried about? - Or am I missing something?
what gazza said....... maybe you should have said about the scratchs instead of just showing pictures, as they might not show up?
but if he looked at the bike for over an hour, and still bought it, i would not worry about it

Ebay can be propper c**ts if he lodges an appeal with them, they can take the money back type thing!!

If he is making a big purchase, it is up to him to inspect the bike and ask questions. If you dont ask, you dont know - its not like you covered anything up!
When I got my SV, I looked thouroughly, and noted any scratches, bad parts etc. Dad took it for a run o check it was sound mechanically. We considered things to be easy to fix, and I brought it with no complaints. Thats how you go about purchasing a bike.
At worst, offer him the money he paid to you in exchange for the bike back. Then you can sell it to someone else who won't complain.

thats the bit im worried about, moneys gone already, paid off some debt

Matti would not do this, IF there was nothing wrong when you sold it

Not disputing your motives here Matt but in this situation I wouldn't do this. The guy has had the bike and it was sold as seen imo. You have no way of knowing what if any damage has been done to it since it left your custody. He could have blown the engine for all you know. If you had the money and you could guarantee getting the bike back in the condition you sold it in then that might have been an option.

Ignore him mate, he is trying it on. Wasters like that put me off selling privately which i am planning on doing soon.

ebay can only take the deposit back as the rest was cash (although im not sure if they have the right to even do that?)
Im hoping they wouldnt be alowed to as the payment didnt come though the Ebay checkout, it was just a random paypal payment from one guy to another nothing to do with an Ebay item

I sold a guitar on eBay a year ago , described it down to the tiniest little detail , the guy in Germany was happy with it until he took it to a "Guitar Specialist" . This guy apparently reckoned the guitar had a broken neck as some paint on it wasn`t the same as the rest of the paint under a UV light , and that some of it wasn`t original and it had been changed around . Little did this guy know but I had been the original owner of the Guitar where it had come from the Gibson Factory . He lodges a complaint with PayPal and I tell them that the paint difference is from where my thumb had rubbed on the back of the neck .. long story short they deemed my auction as accurate and told the kraut to Knob Off , I win . He had the guitar for 2 weeks before lodging a complaint and had taken it apart , as far as I was concerned I wasn`t taking that back as he could have stolen it`s vintage internals quite easily . He was also trying to blackmail me into giving him some money back . If that buyer of yours spent an hour lkooking at the bike then it`s sold as seen , an hour is more than enough , he`s just angry that his eyes didn`t spot things they should have done due to him dreaming about being on that bike an hour later ...... tough I say .

Ah that might be your saving otherwise I would be proper worried about losing the deposit from my paypal account (even if your a/c is empty they can make it overdrawn & pursue you for it)
Of course it will have to go through the dispute resolution & I think you would have a great case that it was sold as seen.
I can understand you wanting a deposit asap to know it is sold, but this is now the other side of that coin.
Glad to know there are proper saps out there like ASH (no offence mate :D) What you got for sale mate? :lol:

If the bike was as you described, then Ebay or not it is the same as "real life" - either be polite and tell him he got exactly what he bought or a simple "off"......Not an Ebayer so not 100% on their wrinkles.
Me? I always guarantee the bikes I sell.........5 minutes or 500 yards, whichever expires first :)
Never had a problem with selling a bike, but remember an RX7 I sold many many years ago - buyer wasn't happy when he found out the cost of an original exhaust (Rotary, kinda part of the engine!) - albeit I did tell him it was "blowing a bit" :).....oh yeah, and the oil all dropped out onto his drive way.......I was very honest with him and told him "why do you think I sold it?" :)

Did he not have it long enough to notice the diff stuffed with shredded rags and grease or the floor panels filled with filler and crushed beer cans then? :-P

If he does start with the ebay disputes, play it through, answer all the points, be calm and, well, professional I suppose... A lot of people complain about Paypal refunds but in most cases I've seen they've done themselves no favours, sending out stroppy emails or refusing to respond. Absolutely DON'T just ignore him as that's one of the things that counts against you. In my experience they couldn't care less about the rights and wrongs of the situation, just whether you follow their process- if someone makes a totally false claim but you don't respond to it, you'll lose.
(example, someone on Oldskool... "Bloody paypal thieves! This guy bought a part and now he claims it's damaged, I've told him where he can stick it but he started a Paypal claim. There was nothing wrong with the part so I just deleted the emails, now they've taken ?100 off me! Rip off!")

Some people only learn the hard way :roll: Which is a shame because that guy may not accept paypal in the future or worse he may not supply good 2nd hand parts anymore.
I too lost out, but only for ebay selling fees after I opened a dispute. I thought I had to wait for a reply & if the buyer didn't respond it would be settled in my favour, but because I didn't do something it ran out of time & I lost out :roll:

Ebay are aware of these buyers who try it on. The buyer examined the bike and was satisfied that it was "as described" before completing the purchase.
Don't worry about it but reply to all emails and any requests from Ebay. I am sure
it will resolve all ok.
