Filtering along a queue of traffic, single lane approaching traffic lights where the road splits into two.

As I drew alongside (50m before the split) car decides they'll nip out and jump the queue. No indicator, not even a slow manouver.

Slid down the side of the car, then the bike went down.

lost the front brake lever, bent rear and lost the right peg. R&g took most of it. Slight scuff on the exhaust.

Off duty copper was in car in front, picked me up and dealt with everything until the coppers arrived.

Police were great, got the bike recovered and told me to phone them if the insurance need a witness statement.

Woman who pulled out was mortified. Her husband is a biker and she knew the score with filtering bikes. I actually feel sorry for her (bizzare!).

Feel a bit weird now. Mrs is fine with me getting back on two wheels so it's with the insurance now.

With a rozzer as a witness, I can't see you having any problems with the insurance.

Glad you're ok too.

Good that you are ok 8) .. but bearing in mind you were filtering/overtaking, what is the deal with the 'blame'??

Sorry to hear this Glade, having said that having the police as a witness is as good as it gets I guess.

depends if its safe or not. Filtering is fine is the cars are stationary/slow and you are travling slowly. Other wise there might be problems.

Glad your OK mate, hope you get a quick resolution!

sorry to hear about the off - never a nice experience, I had a little one 2 months ago and it makes you realise just how easy it is to be caught out. Shatters the whole "it wont happen to me" mindset. Hope you get the bike fixed soon and get back out there fighting the good fight.

cheers for the comments guys.

Traffic was stationary, I wasn't going fast. Copper was happy that there we no grounds for a charge of careless driving after interviews, looking at skid marks, witness statements etc.

There was no real discussion of blame, we'll let insurance battle it out but I'll push for 100% blame on the car driver. To be honest pointing the finger didn't seem appropriate at the time.

I don't think I could have done anything differently, but will be super cautious when filtering in the future.

Dont just let the insurance companies battle it out as their legal people are generally pants. I was in a similar situation and my insurance company were gonna roll over and pay out to the 3rd party. So I contacted Rider Support Services right at the start of the claim and appointed them as my legal representatives (you are perfectly entitled to do that rather than having the insurance appointed numpty) and they dealt with it superbly.

If they take your case on there is no charge for you whteher you win or lose.

You should contact the insurance company and state all the facts supported by evidence. If played right you should be fine. The off duty copper could be a key! There was a letter on this site once stating similar incident which quoted the relevant law and Highway code. If you search the forum you should be fine. Glad you are OK!

I don't think I could have done anything differently,.
If there was room for a car to pull out, then IMHO you were too close to the stationary queue of traffic. Use the whole of the other side of the road unless the cars coming towards you 'protect' you from cars on your side pulling out.

3rd Parties insurance have contacted me, she admits liability and they will repair my bike.

My insurance company are aware, and aren't going to take any action - but have said if i get any problems to get back in touch with them.

I need to get a quote, and submit it to the 3rd party's insurance co, then if they accept it will be sorted.
