View Full Version : Time limit for issuing of NIPs

My sister, the silly girl, has managed to get caught speeding. Normally I'd tell her to be more careful in future and leave it at that, but as it was a main trunk road with a stupidly low limit I'm seeing if we can do some good ole weaseling out of it.
The date of the offense was the 19th of June, but the NIP is dated the 18th of July. As far as I can see, that's well outside the 14 day limit and thus void? Opinions?

Unless there's an acceptable exception (hire car, company car, not registered keeper etc) that would mean it might take longer for them to find the driver, you will be safe.
If you write back they cannot proceed. :)
Void, unless she was cautioned at the side of the road, where that acts as the NIP .
They have 14 days to issue the NIP(longer if its a works or hire car) or else they can go sing for it. As those soliciter people in MCN they will know 100%

It was a plod operated camera, and it was her car, which she's owned for months.

Is it an NIP or the summons? What I mean is, was she stopped at the roadside and spoken to by the cop operator or not?

It's a NIP, she was got by a camera and wasn't stopped.

I would also ask in the same letter for the evidence photos which will confirm the date the offence took place - personally I think your sis will be OK.
I think I will be getting a ticket myself on those new M25 jobbies on the widened section by Heathrow, car in front of me was going steady at 60 and the signs changed to 40 and the burk thought breaking really sharp would be fun, I had to swerve into the left lane to avoid his stupidity by excellerating to keep ahead of a 40 tonner, I think I went through at about 66 by the time a few gestures were waved.

Sounds like they may be pushing their luck and your sis has had a luck escape.

Just a cautionary note. Failure by the police to issue a NIP within 14 days is not a bar to conviction in a case where the court is satisfied that neither the name and address of the accused nor the name and address of the registered keeper could with reasonable diligence have been ascertained.
I should think she's probably got away with it, though.

I've just had a NIP for doing 67mph in a 40mph zone, at the end of a 70mph section of Dual Carriageway. (funny how the mobile speed camera is placed just there where people may not have slowed down in time!)
The date of offence was 15th June, but the NIP was dated 17th July.
I noticed only last week that my postcode on my Drivers License has a digit wrong, would this be suffucient grounds for the NIP being legitimately late?
Any help/advice would be greatly appreciated, as I REALLY dont need hitting with this one!

IANAL, but the post-office could still be expected to deliver to the wrong/missing postcode. Is there anything with the NIP to indicate they have had difficultly tracking you down, and what's the postcode on the NIP?
Edit - they write to the Registered Keeper, so the license address is irrelevant. Is the address on the V5 correct?

I've spent the last 2 years going through that section on a daily basis and never heard a peep. Generally doing 30+ over the displayed limit. You should be OK :grin:
I have heard that only the gantry near junction 13 has a live camera, and the rest don't work, although that may flash from time to time

Address in the V5 is okay, as is the address on the NIP.
Now I think of it though, i didnt get my V5 until about the date of the offence, after buying the bike in mid May and it taking about 4 weeks.
I dont see how it would then take 32 days to issue the NIP though.

I appreciate you are in a better position to know the ins and outs of this than me, but I was under the impression that police-operated ones had a much longer window (6 months, IIRC) than the civvy ones, in which to issue the NIP? I'm sure I've got the wrong end of the stick, but if you could clarify this I'd much appreciate it. :smt023:smt023

Ceri, nope, the law is the same for us as for the camera partnerships. NIP MUST be there within 14 days. Usually though, cops will stop the car at the time and issue a verbal NIP with a ticket, hence nothing through the post.
If a cop stops you and says it was too fast for a ticket, you will still get the verbal NIP and then the cop has 6 months to issue the summons.

I've checked and my V5 has a date on it of 26th June (I bought the bike on 15th May, but the keeper didnt send the info for a few weeks) which although was after the alleged offence date (15th June), was still 20 days before the NIP was issued (17th July).
What's your personal view in terms of that?
Any ideas/advice would be greatly appreciated although I know it'll come down to individual cases.

Ah, that's what I was thinking of. Ta for clearing this up. :)
so would have been a £60 fine and 3 points?

Correct its void. They are trying it on.
I had it two days late and I refused on the timeout clause and I was not fined nor did I get points.
Sadly on another occassion I was not so lucky BooHoo
