hi all,
my insurers called me this morning ref my off, and said that the third parties insurance will be sending an accident investigation team to the scene of the accident and is likely to take about 6 weeks...pfffffft:(
Im assuming that this means he has disputed liability? (sorry for a dumb question)...sounds like thats the case but ive not been involved in a claim before so just checking?
also...my insurance company assigned 4th dimension to collect and repair my bike, 4th dimension collected the bike and declared it a right off...and on the phone this morning my insurance said that they will have to send one of thier engineers to see the bike aswell (but are 4th D not considered "their" engineers as its them that use them for repairs?)
a confused bikeless dappa d

Were the police not involved, if so there report will supersede any other taken (got a few experiences with that).

Sounds logical in the insurance world, it has to be written off by one of there own assessors (i.e. the company they employ to do it).

no police, didnt have any experience of being involved in an accident (apart from car day after i passed my test 10yrs ago! and it was my fault:()...stupidly didnt even think to call them at the time untill it was too late, the guy was pulling into a pub carpark so could have had a tipple at home/other pub before going to that one, we lives and learns if theres a next time

ah thats fair enough i just assumed that would have been 4th D.
I've had a similar thing happen to me when I rode straight into the side of a bus that had jumped the red lights. The bus driver disputed this and so the accident investigation team were called out. It became apparent he had gone straight ahead when the green left filter arrow had come on.
My point being, just because they are disputing liability, does not mean you will be given that liability.

They are not blaming you Dappa, just trying to figure out the events. Ask for a copy of the report, you are legally obliged to have a copy.

I'm still waiting for an outcome following the big off in 2004. The final court settlement hasn't even been given a date yet.

actually after DD's and Hovis's last replies...does this mean u have no payout for your bike untill fault is proven/sorted out?
thats more worrying, as id not have my own commuting transport (although will get a hire bike when not injured but still...)
in my head i was thinking as far as injury compo goes which is neither here nor there as ive not lost anything bar a few weeks off work, but id have to wait for my payout for my bike too then? possibly years like u guys? thats not good!

You can get an interim payment, this will help as a preliminary compensation which you can use to repair the bike. This what I did when the old fart (:smt067) pulled across in front of me. After my first big off, where the lovely woman (:smt071) tried running over me and my bike, I started the repairs from my own pocket but kept all the receipts to claim back.

Yup, I've done that also.

i took my bike for a ins quote and they said somthing like a grands worth of damage, but IMO there was nothing realy wrong apart from a few scratchs, it was a 10 year old bike, and a few battle scars just add charicter
so i never got it fixed, i just rode it for a few months then sold it

Aye, but an examiner looks at the parts so a scratch to the side fairing (£130) and silencer (£768.27) is a whole new panel/exhaust.
