Are you referring to the 'Hiltlers wrong bike' on youtube, which is absolutely hillarious if anyone hasn't seen it.

that news article is interesting. There's been a few times where I've been cruising at 90 on the m'way where I've thought that I've nearly been caught out/about to be pulled over. I've often thought about what I'd say if I was to be pulled.

It'd have to be something along the lines of:

"the road is dry, traffic is light, I can see for a very long way ahead of me, the tyres have more than sufficient tread since they've only been on the car a thousand miles, they're also at the right pressure since I checked them on sunday, the car was serviced and mot'd only a month ago so there's very slim chance of anything going mechanically wrong & causing an accident and I'm paying full attention to what's going on all around me, so I don't see how I doing anything dangerous..."

basically demonstrate that I'm making an informed decision to travel at the speed I am. If the road turns damp, visibility drops, traffic becomes heavy = I slow right down...

That would help with escaping a dangerous driving charge, but as in the article above, you'd still be legitimately done for speeding. :)

Does anyone know when this was made law? Was it just now :( ? I was in a collision in February 08 where by I was going approximately 10-15mph past stationary traffic lined up and when adjacent with a saloon car he did a u-turn (claimed he was moving to park at the other side of the road) I tumbled, fecked me bike, back and neck (and sprained my wrist, sounds minor but I still can't shake hands). My solicitor has informed me (dispite telling me all the way along when I was considering not claiming we would get 100%) that we could easily get 80% in our favour as we had an appauled witness on our side. The other party have so far offere 50/50. Bearing in mind at my age a claim puts my insurance up £700 on a car and ups the bike policy too.

The article Hovis linked to says that the judges decision was made in 2006, and by the sound of it, it applies fully to you (usual not a lawyer disclaimers aside). Might be worth talking to the solicitors and reminding them about this case, as they might be going on the 1972 case as precedent.

Standard response, if your solicitor is any good he will already know about this judgement and lurking somewhere on here (or someone will have a copy) is Lynw's letter about just that sort of thing :) Unless you really really have to accept nothing less than 100% against other party, may take a little time but you will also be able to claim back a lot of the extra premium as well ;)

If I have to go less than 100% it's not worth it as it's £7o0 a year up on car and a couple hundred on the bike. I'm just waiting it out, ready to go to court if I have to.

Thanks for posting. I'd missed the other posts (dig at duplicate post nazi's ;)). Now I know why my case suddenly quickly in my favour once the solicitor mentioned the shrogin case!!

No not really the case, but I had seen it mentioned before so it was not "News" as you purported it to be.....
I thought Hovis was just admitting that he was a muppet for only having "found this today" rather than "purporting " it to be anything.
