View Full Version : Need legal advice re call centre taking fees.

I recently checked out a loan with yesloans.
Over the phone they requested my credit card details which I stupidly gave them. On my next statement i noticed £59.50 had been taken.
During the entire course of the phone call, there was no mention of this whatsoever.
They have now refunded £54.50, but I have nothing to do so i'm writing a further letter to attempt to get the £5.
They claim the reason for the £5 less is because it is a refund, and that under section 155 of the consumer credit act 1974 they are eligible to take this £5 which I would agree with if they had legitimately taken the fee in the first place.
However, as they did not ask me if this was ok at anytime in the call, I believe I have some legislation to stand on...if I can find it.
Therefore, I just need to know is such legislation exists and where I can find it. surely they cannot just take money from an account without telling you?

cant help with the legislation mate, but do your homework before applying for a loan, yes loans are just some jokers who take all your details, and then charge you to go find a company that will give you a loan (if your in a position where you nedd their help, i wouldnt get a loan at all mate)

tell your cc company its an unathorised transaction and they will take the money back, if nescacerry declare it as fraud.

And yes I know, the problem is I was in a position where I could afford a loan but my age and the current climate for such things meant it was hard to get any respectable company to offer any loans.
The idea of reporting it as unauthorized is good except, my mum works for a fraud department in a bank and she said that wasn't an option something about something or other in the bank.

If you didn't consent to the charge ion the first place then you should get back the lot. Complain like stink to the card issuer, they will lean on yesloans. However - for £5, there will come a point where it's uneconomic to pursue.

Sorry but she is wrong.. unauthorised payments from your card are FRAUD...black... meet white....
If the card issuer choose not to persue it then thats a problem for you and the car issuer to resolve.

I'm only bothering because i'm unemployed, as you say its £5 but I have so much time on my hands at the minute.

i work for a competitor of yes loans, central capital,
both our comapanys work the same way
difference is we dont charge the customer a fee, what happens at yes loans is
application
charge you
look for a loan
a) get loan, you get loan, yes loans receive a commision from the lender
b) you dont get loan, yes loans has got a little sumthing off you
our comapny, application,look for loan, either yes or no, if you take, get paid only via the lender, not the customer, however lenders always charge you a little more if you have gone through a broker to recoup costs,
3 vital points for you to take away, 1. never give out your credit card details unless your making a purchase, they wouldnt need the numbers etc off you otherwise.
2. unfortunaly mate as hard as it is being unemployed no lender will look at you, thats none, we deal with the same lenders asy es loans pretty much and the only comapnies that will look at you are doorstep loan companies such as provident,
3. if a comapny says they have you a loan, they just need the fee befor they send out the details and put money into your bank, ( i wouldnt belive them) but ask who the lender is, if they cant tell you they ent got didley

Ah I had the job at the time of looking for the loan, and it was only a quote - which is why i was peeved at the cost.
