Right I got caught speeding on the M6 last week but looking at the ticket now (need to produce my licence today) some of the vehicle details are incorrect. Nothing major just says the car is a manual when it's not and that I had no passengers when I did. Could this get me out of getting 3 points or is it irrelevant?
It was an unmarked car and he got me with VASCAR
need a quick answer to this please.
I'd say gearbox type & passenger count has nothing to do with the speedo.
Granted the cop made a mistake, but hands up time IMO.

Oh I admit i was speeding but was hoping to get away without the points on a technicality ;-)
If you really really wanted to get out of it then you probably could. Innacuracies show incompetence.
Go to court and question various parts of the ticket which are wrong, then theres resonable doubt about other aspects of it, it would probably get thrown out 'on technicality', this is mainly what nick freeman does.
Time consuming and costly......and if you were on 9 points probably worth ago, otherwise just except it.

There might be a way but in general if the details that are wrong aren't significant to the offence, then it won't make any difference to a court. Things like you mentioned are unfortunately what I'd consider not significant to the offence.

No you don't, you've got 28 days to either pay the £60 and surrender your licence for the 3 points.
Just because they only gave you 7 days to produce your ins, Mot & licence at a police station doesn't alter the 28 days to decide whether you want to go to court.
Me personally would be staying the hell out of court if at all possible.

Pretty poor by the copper. I mean what if you only had an automatic licence?
couple of times I've told them I was coming from work but they put on the ticket SDP which I thought was pretty lenient in case I didn't have commuting use on my insurance

If they can't get simple facts like this correct, then how can we trust them to correctly read the manual for and operate sophisticated equipment such as VASCAR?

you could try going to the cop shop and threatening to tw&t them in the face unless they let you off. thats what i'd do. :evil:

Its true, dont sign it and say you want it to go to court. Dont tell the police what your defence will be.
Simply present yourself and say the above. I'm pretty sure you would stand a good chance. Its not like you can argue against it.

I'd talk to someone legally qualified first to see if you had a case, because I think they will say it's immaterial to the case (whether it is or not is another matter)...

Did a bit of thinking around this, if I remeber right (so I could wrong here) if thats the only things wrong then yes the tickect would still count. I take it has your name, dob, vrm, time, where it hapened address ect are correct right? Those are the important bits, along with what ever evidence the cop writes up.

Surely it's worse to say you were speeding with passengers than without?

Dan, I suggest you go through New Leafs previous posts - if the police are involved it invariably suggests a ****ting to the face.
Was funny the 1st couple of times but fairly boring now I will admit

If you go into motoring solicitors sites a few give a free appraisal, so rather than listen to barrack room lawyers my suggestion is get professional advice.
ALSO----------Check if any of your legal protection policies covers you for motoring offences i.e. My Direct Line Household Policy did and covered me for over £2000 of legal fees

It's not an issue. Errors like the ones described on the FPN will NOT invalidate the VASCAR reading.

Already done, hence the comment. It tires quite quickly.
