Argh!!!!!!!!!!!!!!!!!!

I was driving my car the other day when some old fool decided that he wanted to be in my lane but couldn't be arsed to look in his mirror. End result, both cars crumpled. The cheeky git is claiming it the other way around and as there are no independent witnesses the insurance want to go 50-50.

Did you stop and take any photos? Would they suffice as evidence if so?

Wouldn't it be obvious what happened from the location of the damage to the cars? Surely if they changed lanes into you without looking in their mirrors and checking the blind spot, their damage will be on the side near the back of the car and yours would be damaged near the front.

If so you could argue that you obviously wouldn't change lanes into a car you can see in front of you.

We were side by side on a roundabout until he moved over. I accelerated to get out of the way (barrier on my left so no escape route) but didnt get passed. Damage is my rear door and his front arch. I was in the left lane to come off the roundabout, he was in the right and moved to left. The annoying thing was that both lanes could exit so he didnt even need to do it!

What is really worrying is that if I'd been on the bike I would most likely of been hurt.

So the idiot drove into the side of you, despite the fact you were clearly visible (must be since he hit your rear door) in front of him!

I think with the location of the damage you would be able to fight that!

Fight it. Load of dribble.

He's hit your rear 3/4, and says he didn't see you

I'd contest it saying you want that person to have an eyetest if they can't see a car right next to them....

due to how we in this country go round a roundabout the damage cause equates to more or less a rear ender point that out and tell your insurance that under no circumstances you will accept a 50/50 you'd go to court first, they do that to make life easier for themselves

Says that he saw me but that I changed lanes across the front of him

What a way to exit the roundabout that would have been, swerve back onto it. I just hate the insurances sh*t attitude of making it 50-50 because its easier for them.

Don't let them. They will only be able to make it 50/50 if you let them. Tell them that you will not accept it, contact the Insurance ombudsman (will need to wait 8 weeks to allow the insurance company to change their minds) and get the ball rolling.
You will only have to take a 50/50 if you accept it. Do you have legal cover? If you do, they have to be impartial, so use them and make the insurance company pay out more!

I learned through experience that you can change even the things that are set in stone sometimes if you are willing to fight!

in other words ,he is trying to say that you "straight lined" the roundabout.
Unfortunatly ,it may look just like that.

Surely the damage to the front of his car, and back of yours shows that HE went into you?! I can see why you would be so annoyed. I'd be irate.

I know we want to support forum members, but we can't have it both ways!!

Hope you get it sorted by the way - without witnesses 50-50 my be your only option. Sucks.

The only clear unargueable position would have been to have stopped both cars immediately and get pics of where both cars were on the road, however without that I fear you may have to bit the bullet. The guy may be on another forum bemoaning the fact that you ran into him etc etc.

In an ideal world I could have done that but the incident was in the middle of the rather horrible roundabout just above the marker in this link:
http://maps.google.co.uk/maps?q=white%20city%20circle&oe=utf-8&rls=org.mozilla:en-GB:official&client=firefox-a&um=1&ie=UTF-8&sa=N&hl=en&tab=wl

Stopping there would have caused a bigger smash and I pulled in at the marker. Unfortunately he was the one who straightlined it. Rather than stay in the right hand lane of the roundabout onto right hand lane of the exit (as he should have done) he moved from the right hand lane on the roundabout to the left hand lane of the exit, which unfortunatly I was occupying it at the time.

I'm fully intending to fight this all the way as it will cost me my excess and no claims anyway if I dont, its just so frustrating that I could be significantly out of pocket for being in the correct lane minding my own business. :-({|=

ahhhh the joys of motoring :)

Wrong place wrong time, a court might not be too pleased that you "put your foot down" to make the gap I tried to use this to get out of a speeding ticket once. It was infact 100% true if I didnt put my foot down I'd have been sandwiched between a lorry and a wall, not a pleasent idea in a 106. They however only heard "put my foot down" and decided had I been a good motorist I'd have slowed to let the truck across. A court my see this the same in your case and simply ask if you saw him coming across why accelerate? I know why you did it as I would (and have) done the same thing but in both cases we clearly made the wrong decision.

Maybe your too used to been able to wind the bike on to get out of these situations. Forgetting cars cant pull the ways V-Twins do :) pWAARRPP

Definately wasn't the wrong decision, had I braked he would have still hit my front end and the car behind me would have been in my back seat.

Yeah you have a very good point. Never ever say that you accelerated or anything. Always remember, YOU were driving 100% in compliance with the rules of the road and doing nothing wrong. Never forget that and you should be ok. :)
