Can you pass an MOT on a spacesaver?

I'm replacing one tyre due to tread wear, another is showing the very first signs of perishing but tread is still fine. Would it pass MOT on the spacesaver?

It would fail:

Reason for rejection:

1a. One tyre is of a different nominal size or aspect ratio to any other on the same axle.

b. Special lightweight or space saving wheels and tyres fitted as road wheels
