Folks after your views on the following;
On the 11th of December I sold a perfectly working digital camera for £80 on ebay. The camera was delivered and I didn't hear from the buyer till today.
He is saying that when the camera is in photo mode the lcd screen is not working and hence they cannot see what they are photographing. The screen works fine when taking video or viewing what pics you have taken.
Now I used the camera just before I packed it and I did wrap it in loads of bubble wrap. They buyer did not make any contact prior to today which means that while the camera was in his possession he could have done anything and everything with it.
As a private seller by law my item only needs to be as described and it doesn't have to be fit for purpose or of quality. I did state in my auction that returns were not accepted for this item! There was nothing wrong with it when I sold it but cowboys such this guy could have used it, broken it and then asking for a return.
Do I have to accept the return and refund the guy?
What would you do?

Welcome to eBay, your choices are as follows:
1. Refund the guy even though he's broken it / doesn't like it / decided he can't afford it / intends to steal it, possibly receive -ve feedback
2. Have the guy whine to paypal and have them forcibly remove the money from your account, even though he's broken it / doesn't like it / decided he can't afford it / intends to steal it, then freeze your account so you can't use it, definitely receive -ve feedback
As a seller you have no rights on eBay, or with Paypal:(

is it one of the type where you can switch between electronic viewfinder and lcd screen, to save battery life, and all he has to do is turn on the lcd screen?, only say as mine has that function. if not well you did say no returns. hth.

I had this a while ago with a new mobile phone I sold.
The phone was still boxed and I listed it within the week I received it.
3 months later the buyer complained that there was something wrong with it and wanted a full refund.
I removed all my cards and accounts that were listed with paypal so that money could not be removed.
I entered a dispute with paypal as I knew there was nothing wrong with my item.
Its a gamble selling on ebay, and being honest, I cant be bothered with the hastle of selling on there.
There are plenty of scumbags out there who try to rip you off and I hope you can sort this one out without being out of pocket.

Dont forget as a seller you have to pay ebay/paypal (same company) on average 20% of everything you make for the privilege

Just remember if you sell an item on ebay, if the buyer decides they want it for free they can just have it for free.
The easy way of thinking of how ebay works is:-
Everyone who buys something from you on ebay still has a string attached to the pound notes in your bank account and can pull it back out of your bank account for up to 60 days no questions asked.

Yes I will second that, ebay is a buyers market now and paypal will refund the buyer everytime, I will never sell an expensive item on ebay ever again becuase of the paypal payment system which you have to offer now. It really is a gamble if the buyer is honest or not.
The easy way is to do as Speedplay described and remove all accounts and cards from Paypal as soon as a dispute is entered. That way they can't pull any funds from your account.
Personally, I'd tell the buyer to go stick his dispute where the sun doesn't shine, and remind him that he bought a used electronic item with no warranty given or implied.

Can you not tell him to return it fr testing before the
refund?
Possiblynot, I do agreenwith the above. eBay has gne downhill as far as sellers are concerned.

I bought a seat unit off ebay a few years ago, via paypal, they took the money twice from my account, leaving me overdrawn and because of this I missed two DD's. They refunded the money and luckily the Halifax let the DD charges go.
Couple of weeks later I recieve a very cheeky e-mail from the seller demanding the payment which he says paypal took away from him.
Needless to say I told him to get stuffed, but the fact remains that you might as well leave the money sitting on your doorstep than trust it to ebay/paypal.:rolleyes:

You need to remove them before really as they can freeze your account.
Remove all your details from paypal and then raise the dispute yourself, tell paypal hes being a knob and see what happens when they decide to put the ball in his court.
Hmmm thanks folks for the views.....he has not responded to my email from this morning. I have to say I've used ebay for some years now and have about 170 +ve feedback. I think I will remove my details from Paypal for the time being just in case he does decide to ask for a "forced" refund :)

Yes be careful, I had to investigate a case where a seller had a very expensive model train returned...only it wasnt a model train in the box, it was a water bottle filled with cat litter to be the EXACT same weight as the item sold so that when it was 'returned' the seller could claim that he had returned it, ask them to check the weight and get away with it, worst bit was that Paypal had already credited the buyer's account too, so the seller ended up with no money and no item!
this is why i have nothing to do with ebay or paypal anymore.

someone complained they never got a book i sent, not recorded so it was my fault?!?!?! i removed my details and paypal have sent me an e-mail saying i have a month to return my account to balance zero or they will take me to court for £4.95, that was 2 months ago tho still not heard nothing else back so i dont use paypal anymore cash on collection only
