so my girlfriend gets a bike come through free which alot of you will have read,
now last nite after a training corse, in a pub, found a phone wedged behind the sofa,
read the txts which said if you find this phone call this number,
did that no answer
txted the number explainiung had found the phone would he like to come and get it.
txt back, no mate, have left area, phone blocked, getting another on insurance
now so ive got a blocked phone, dont want to bin it, i know it will work abroad, can i sell it on ebay or or will voilate rules, its not stolen, and ive tried to return it,
seems a shame to bin it, no point in recyling if they wont take blocked phones,
Hand it in to the police ..... their problem ....

I'd be tempted to bay it.
Guess if you hand it into the police the owner may get done for insurance fraud.

well he lost it a few days ago, hadnt found it, claimed on insurance, seems a valid claim to me,

Hand it over to the Cops.
There is an offence of "Theft by finding" and if it is reported stolen and you sell it on Ebay, guess what?

No point in giving to police, just create more work for them repeating what you have already done.
Odd the owner didn't want it back, even though its blocked. Would have thought his numbers on the sim or in the phone etc were of value.

yeah i thought the same, offered to send it, but he said dont bother, prob get a better more upgraded phone, its not theft, i havent stolen it, i found it contacted owner who didnt want it back, so therfore its now my useless blocked phone, well how i see it anyway, hand to police, ok thankyou, fill out 600 forms, and send it off to be destroyed? no use to anyone then, waste,

Is that still true despite the owner seemingly giving it him?
Or would it be stealing from the insurance company or something?

phone now belongs to the insurance company, either sell it in the pub for a tenner (untraceable) or hand it into police

Plus we access to a database that tell us who each phone belongs to, if it's registered. So, if it is, it can be returned to owner.

The real question here is did you REALLY not know that if you find property you should hand it into the police, or were you just looking for permission to keep it?

tut tut i was always brought up that if you found something you handed it inot the police.
Just out of interest what kind of phone is it?
stick it through the rear sprocket of your bike whilst rear wheel is spinning (Note DO NOT DO THIS!) ... and video it and post it up on youtube.

This plumber listened in the training course:lol: Williams -v- Phillips (1952) is the authority for the proposition that you can be guilty of theft by finding - in that case, bin diving. If reported stolen, and you have sold it, you have handled stolen goods. Knock knock....

Hang on. There's a database of mobile phone owners? Did everyone on here with a mobile - pretty well all of us - know that we're on a secret database? I didn't... Pete - can you say what individual details are recorded?

I'm assuming it's only if you signed up to it (either by contract or at somepoint after buying a pay as you go phone), I know I signed my details over to orange so they'd let me top up by card.

They only have the details you supply to sign up to the contract or when you register a pay as you go phone. It stemmed from the million people who "loose" phones or report them stolen to get a new one. Once reported, the IMEI for the phone - which is individual - is blocked from the networks. Then, in thory at least, the phone cannot be used.

the bike that had been sent in error, isnt mine, its my girlfriend, ive warned her of the consequences of keeping it, and she shiuld think long and hard, and showed her peoples responces, and now its down to her,
the phone, no i didnt know i should hand it to police, especiasly after ive contacted the owner and he said he ddnt want it back, if i couldnt have traced the owner then i would, and the police would have done so, and then destroyed it after he said he didnt want it,
so checkmend is a database that checks serial numbers to see if things have been registered stolen, costs you 1.99 to access,
i wanted to know what i could/couldnt do with it,
weve already established police would prob destroy it and to me thats good money down the drain, the insurance company, what will they do destory it, and im not gonna contact the owner, ask insurance details and send it to them

Is it not the case that if you hand something in and the police cant trace the owner, or they dont want to collect it, you THEN have a legal claim to it?
