View Full Version : I have just been done by scambay.. *sigh*
Almost a month ago now I bought a laptop to repair (something I do in my spare time) and then sell on (not for profit, of course ;)) Anyway, the laptop suffered some extra damage in transit and I explained this to the seller, who was very appologetic and said she would contact DHL and sort everything out.
To cut a long story short, we had an agreed amount, DHL were going to pay, and then all of a sudden she said she needed the laptop back for DHL to examine. I said fine and sent it back.
Today I got an email saying "thanks for the laptop I have refunded your original ebay payment" - Blatently taken the insurance money and will stick the laptop back up on ebay for some extra profit, nothing I can really do about it, really annoyed, just thought id vent a little :)
This happened to anyone else? Anyone fancy starting a s***list? :)

had this done with some exhausts a while ago..
I wrote it off as wasted time then got on with my day..

Inform DHL that they are getting scammed and that the person is reselling the laptop. See how far that gets her!!

I would imagine that the laptop is still legally yours.
You paid for it. Sent it back for DHL to examine it. At no time did you agree to sell it back to her. I would say to her that she still owes you the laptop. The fact that she has sent you some money is irrelevant. You did not agree to sell it.
If you really want it back, explain to her that she has a legal obligation to return "your" goods after examination.

He's got it spot on, when you win a bid on ebay, its a legally binding contract. If she has good feedback, then tell her that you will be contacting ebay.
But, at least you got the money back, alot of people wouldnt have heard from her again...

Maybe she told DHL the laptop was perfect before sending to you?
Might be worth asking them..
Ah well, still it is Friday and as they say, you got your money back. Just a lot of faffing aorund i suppose.
Yeah, I know legally im in the right, but where am I going to realisticly take it? Small claims? I had a similar case where I bought a hard drive for £50 that was meant to be sold for £500, the seller made a mistake in the buy it now, but i spotted it, nabbed it and paid for it, so should have been sold it. Despite following ebays lengthy complaints procedure, nothing was done, I never recieved the item...
Just a good old moan really - and as you say, I got my cash back, so at least thats something. Although - paypal would have covered me in the event of her not paying me back I think :)
tbh, you got your money back, which isn't really being scammed.
I'd just put it down to life, and forget about it. Really not worth the hassle for a broken laptop.
