Ey up Everyone..
Been lumped with a Comet gift card to the value of £324.01 Due to our brand spanking new Sony Bravia TV being faulty straight out the box.
Asked for a cash refund but due to Comet dragging their heels sending out engineers and waiting for parts, a gift card was their only alternative offer.
Seen as we're now using my other TV, we have no need for the gift card.
So.....Anyone who wants to save £24.01 next time they visit Comet and buy the gift card for only £300, let me know!
I Can accompany you to a local store (local to me!) for peace of mind if you prefer. Either somewhere near Aldershot (Hampshire) or Wakefield (West Yorkshire).
Failing that i'll post it first class recorded :)

Sale of Goods Act 1979 says you should have been given a cash refund I think as the item was faulty straight away. Don't believe they can force you to spend again in their shop, which is what the card is essentially doing. I'd call H.O. and rant a bit. You'll get cash pretty quickly.

Comet sold me a dodgy telly back in the days of huge heavy CRT based systems.
I did my back in taking it back same day as I bought it. (Boxing day sale, I was initially told to call a service engineer by the store, but the department wouldn't be open till the new year. Like I am going to wait a fortnight with a new bust telly)

Just quote Statutory Rights:
When you buy something from a shop you are entering into a legally binding contract. Therefore they don’t have to give you a refund simply because you have changed your mind. Only if one of your statutory rights is breached (i.e. that the item is damaged, of poor quality or not fit for purpose) do they have to give you your money back.
Shops will often tell you they will only give a refund on production of proof of purchase. Don’t be mislead into thinking this must be a till receipt. It can be a bank or credit card statement, although you may run into difficulties if it is for a different amount than that of the item you are trying to return.
The item you bought was not fit for purpose and you can request to have your money back, they'll try and give you a credit note or whatever but they are legally obliged to give a full cash refund.
You'd be suprised how many people in a position to give refunds or deal with complaints don't actually know the customers Statuary Rights. And the mere mention of them will get you your money back.

If they don't budge ask for the store manager.
In my experience they don't like to be hassled with stuff and more likely to 'make an exception' just this once.

You'll get it back. Google "Sale of Goods Act" and take some print outs with you. Stand at the till talking slightly louder than you usually do, saying how awful the service is and that you can't believe anyone would buy from there based on the after sales service. Once other customers start looking round, you'll be suprised at how quickly they change their mind....
use the Tannoy system...bing bong....:lol:

It's not going well, he's not budging even after quoting the sales of goods act, then I got a bit sweary and he threatened to call the police!
I'm gonna stay here all day if I have to...

Honest question, do they have to give you cash if you have accepted the compensation of a credit note?
If you had refused the credit note I could understand them giving you the refund via the method of payment, but having taken the credit note have you not ended the contract you had which gave you the right to a cash refund?

Did you pay on your credit card...if so talk to them. I think you have comeback with a credit card. I think you can request they don't pay comet.

I don't see why not. He's returning the full credit note as he has been made aware of his actual rights.
Tatcom, ask the manager for his number and tell him you'll have a solicitor on the phone within 30 minutes to make him aware of the law. I'll give them a bell and run him through what he can and can't do. I'm assuming you returned the item within 6 months and presented an original receipt? If that is the case, then it's cash refund without question. Bit more difficult if you had no receipt but still doable!

After much to'ing fro'ing, and him emailing 'head office' and informing me i'd be waiting all day for a reply, i decided to ring them myself.
Whilst being told they would ring the manager and speak to him as I was in store already and being put on hold by said head office...I watched him pick up the phone and saw the moment his heart broke as he was told he'd have to refund my card...pity it wasn't a mastercard, otherwise then I could have said it was 'Priceless' :)

Stay very calm and then mention the fact that Hugh Harvey ( Managing Director ) will not be pleased when he hears as to what is going on.

P.S thanks for everyones helps and suggestions, i would have just rolled over and took it otherwise.
P.P.S Chris, I know what you mean, but when I was originally given the gift card and told it was the ONLY option, i did argue, but told i'd have to sort it out with head office and make a complaint myself if i wasn't happy.
what was the managers name, i am gonna ring and give him verbal....
I reckon we should all ring saying that we have a faulty item and can we return it for a refund...

Result. You should still write to them and complain about the way you were treated and how your rights have been breached and the time stress etc.
You may get a comet gift card as compensation.
