Ok so insurance company after a third party fault accident have written my car off.
what do I do.. ?
what do I need to know?
how can I buy it back ??

Erm. You ask the insurance companies these questions. Find out what catagory the write off is. I think you can only buiy it back if its a Cat D (Not 100% on that) if so then ask for a buy back figure, then this is deducted from your payout. You get the car back then you have to repair it and get it MOT'd i believe. Job done.

I never had anything written off before..
with the exception of 2 marriages.. .......
it was only a side panel but it was mended 2 weeks prior for the very same kind of accident and they took £200 EXCESS OFF ME THEN DIDNT WRITE IT OFF THEN ..
but now maybe they cant fill it as it had just been filled 2 weeks ago or maybe it needs a new panel welding and spraying etc... it looks a nice car, but it not worth the £££ it would cost to put a new panel on.
but If I could buy it back and get it done somewhere for cash in hand it might be ok..
only just had 4 new tyres and the cambelt done and new windscreen

ask these questions
what catagory write off (dont buy back if not c or d )
what have you valued my car at
what is the current scrap valuation of my car
if you do want it, ask to buy the car back at the scap valueation, (most not all will do this)
fix car, mot car,
inform new insurance provider that car is a cat *c/d* when taking out new policy ,your old contract is finished once you have recieved payment also confirm this (eg outstanding premiums)

I had an XJR400 stolen recovered a few years back. The guy had broken it into large lumps to try & disguise it. I loved that bike & tried to buy it off the insurance company. They gave me a blatent "no" & reckoned it had been sold to a breakers yard. That was even before I had the settlement sorted with them, so I think that it depends on your insurance company Quiff.

car is at the repairers nominated one by insurers..
I bloody go on holiday tommorow.. and want it squared away today - they have had the car 10 days already .!
it has my private plate on too and I looked on internet and could lose that if I dont act quick.. ?
it has really ragged me up and is worrying and stressful

surely they cant write it off without me agreeing.. I should be put back in the same position as I was immediately before the accident .. so i could take them to small claims I read on the net to ensure they dont write it off.
its a reliable car- looks worth more than it is .. has never let me down.. I have service it.. just had 4 new tyres and cam belt and tensioner etc - so there is a lot of investment in it . I dont want to lose it.

If it is a third party fault and your insurance has a claim against them and the car can be repaired,if expensive,demand that it is repaired------Why should you loose over somebody else's incompetence
You can inform the insurers of the recent money spent and the cost of transferring your cherished plate will all have to be accounted for in any settlement thereby increasing the claim so it will be cheaper for them to repair

Yep - insist on a repair, not a write off.
Its YOUR car after all, not theirs to decide what is to be done with it.
I had a similar thing with an old golf many years ago. Insurance wanted to write it off but I insisted it was repaired. Accident wasn't your fault so why should you lose out? Remember it is their insurance who is paying out, not yours. If you have legal cover, call your solicitor, tell them you are going away and you want the car fixed when you get back, they should sort it all out for you, that's what you gave paid for.
on a side note, the head gasket on that Golf when 3 months after the repair, should have took the payout when I had the chance lol

Can't offer you much advice apart from get onto some legal bod. If u not covered on car insurance have u legal in ya home insurance?
Also, the the plate is yours..... you own the right to that reg so how cab you loose it. tell them you will happily sue them if they don't act for you, soon change their ways ;)
Just remember if it is a cat C write off you have to have it VIC checked, which you dont need on a bike, so factor that in as well, cost and inconvenience. If it is cat D then it only needs an MOT, similar to a written off bike. Just another thing to try and use against them, as another potential cost, to stop them writing it off.

Happened to me when I had my Golf, was driven into and insurance company wrote it off. I believe chassis was knackered they refused to discuss or offer me a buy back. In the end I got fedup with it and just took the money and accepted it.
Have they made you a formal offer in writring and a valuation for the car ?
They can write it off whether you agree or not. Particularly if its not safe to be on the road due to chassis damage. Are you claiming off your own insurance and then they are claiming the value back off the third party ?
You need to talk to your insurance company they'll tell you what you need to do next. In my experience its pointless arguing with them. Once they have decided to write it off, thats it. If its Cat C or Cat D they might offer you a buy back, if its not i.e. Cat A or Cat B you cant buy it back as its not legal for you to do so.
Can you not put your private plate on retention and then transfer to a new car once you have sourced one ?
IIRC if they do write it off, they then own the car so you have no say in what happens to it. Its sh*te I know it is, but there you go.
All this based on what happened to me. Like I said speak to your insurance company and see where that gets you.

If another parties insurance is paying for the damage, then you'll get your excess back................................ once they've paid your insurance co.

The repairers will be clocking up a nice storage charge as we speak Quiff mate, normally £20 a day so u need it out of there before u go away if possible.
You also have the right to choose which repair company do the work and dont have to accept what the insurance approved repairers say. When an older car takes a knock, alot of insurances will write them off because new panels aren`t available. Because Rovers aint made any more, they are written off if any panel replacement is required because new panels cannot be purchased.

just written a letter to them in response to an e mail letter I had.. popped on here to see what u lot have said..
then I got to ring Matt Sv - poor man loves me and I aint spoken to him.. aww

they say it is a cat D
they offered me £2450 no car or £1750 and car back .. of course I think the car is worth more cos Ispent £1000 on it etc etc and its leather and a lusso and new cam belt .. so I have sent the bits off and suggested a figure so maybe I get it back and some money and then I got to go get it mended myself..
cant have damaged the sub frame can it etc if it cat D ? anoting that 2 weeks ago I paid £300 toward a £1200 bill and they didnt write it off then??

Car was cat d
Me got good payout after negotiation and bought car back
Will cost about £200 at mates rates locally to mend then we have some spare free money to take Mandy for four days in the sun for her birthday in November
Ta for the advice oh yea incidentally my insurance are saying that even though cat d don't need mot or vic they still insist on them ??? Bit odd ? And another £90 I need to pay
