:cool:Hi all,first time on this part of the forum,hope i can pick your brains,and get an answer thats spot on.Here goes..If you get flashed by a speed camera,is there any legal timescale that it should take to send out your ticket or NIPS? I was told if you do not receive it within 14 days you can forget it. Or is this just a myth? Yours anticipating the postie,tomorrow is day 14!

IIRC the NIP (Notice of Intended Prosecution) has to be SENT within 14 days of the offence. How long it takes to be delivered is not a factor.

What is the 14 day rule?
The 14 day rule relates only to the period of time in which the Police/Process Unit must serve the original Notice. The Police do not have to prove that the Notice reached its intended recipient within 14 days, merely that in the normal course of events, it should have arrived.
The normal course of events does not allow them to post it on day 14, as it cannot be expected to arrive in time.
They need to have made every effort to get it to you within 14 days. It's generally accepted that they achieved this if they posted it by day 12, regardless of how long a postal delay might be, or when you actually receive it.
If the letter is dated on day 13 or 14, contest it on the basis that they could not have expected you to receive it on time.

PS: If its dated after the 14 days, then it's not a case of contesting and asking them to prove when they posted it.
If it's after the 14 days it is "Time Barred" which is completely cut and dried, it is there on the paper in black and white that it is NOT valid for a speeding offence.
Not all offences are subject to the 14 day rule BTW.

quite funny really - the police are whinging about the cuts here in Sussex affecting the public's safety yet the only time we see the police is either manning speed traps or via the speed camera vans, you NEVER see them out of cars or in the town centre. Strange how they even managed to have a week long purge collecting revenue from motorists driving over the speed limit yet are bloody useless when it comes to crime! Having been burgled, having had our car stolen and written off and having had our property vandalised and a few other issues - all of the occaisions and the police didnt do anything.... still a quick NIP in the post stops drink drivers, stolen cars, uninsured drivers, unlicenced drivers but more importantly bumps up the "solved crime" figures and raises revenue - bitter??? Me????

That must be East Sussex because Chichester has police on foot all the time.

This would be quite a good post, if only Camera Partnerships actually involved the police. In reality there's unlikely to be a single real copper working there, so I'm afraid your argument doesn't stand up.

it does when they are funded "in partnership" by the police - money that could be used to fund proper coppers on the beat
- by the way just so for background knowledge - I'm 41, I'm a construction Health and safety manager, never ever been arrested, cautioned or warned over anything, in the past 13 years I've had 3 points for speeding, I'm IAM qualified, have completed 2 bike safe courses, and ride and drive approx 45,00 - 50,000 miles per year, my brother is a police officer as is his wife....

Last time I looked our partnership actually turned a profit (oh the irony), and as it's run by "civilians" it means it leaves all our coppers free to walk the beat (well, not walk, but you know what I mean....)
For your background knowledge I'm older than you, I'm a copper, I've also never been arrested or cautioned although I'm being warned all the time.... In the past 30 odd years I've had 6 points, all from camera partnerships, I'm an IAM examiner, have run numerous Bike Safe courses and do a few more miles each year than you do. Oh and none of my family are coppers, although my brother shot one once.... Where are we going with this?
Moral of the story....speed = might get caught one day. Live with it, hopefully.

Long story, he didn't mean it, he was as high as a kite at the time.... hang on, this isn't sounding any better is it! It was a long time ago in a place where this sort of thing went on quite a bit, am I excused?
