View Full Version : Returning a lemon bike?
Any one know how long you can have a used bike from a dealer that if it gives up you can return it for a refund.
I Did put a deposit on it using a Barclays C card.iI think it might help ?
Were there any known faults when you bought it, or warranty work that may have caused the failure?
I think if you're outside any warranty period you'll struggle to get anywhere though.
What's happened to it?
Wont Run when Warm .
Had to get it recovered back to the selling dealer
Sale of goods act says they have to put it right if it's not fit for purpose within 90 days regardless of what a warrenty says. I used this successfully a few years ago when the Hydro-elastic suspension failed on a Metro I bought for the missus. The right to return it is a lot more difficult.

as above, although you might get your money back via small claims court, under Sale of Goods act.
Tricky one, depends on the dealer and how good they are?
Fingers crossed they sort it.
It is the bike I want in the right color etc.
But don't want to take it on the chin if it won't be reliable . Not 30days yet so sitting tight .

I took mine back they replaced it with a newer model with a higher spec for a fraction of what it would have cost me to buy it :D After trying to fix it and failing twice, you have to give them the chance to fix it, if they can't money back.
Yep will do ,But there being a bit "Off" as i asked on the forum some advise in-case any one else had the issue.
They want the original cans on it but its not easy to travel to the shop after work as there closed don't fancy leaving them by the door.
That sounds a bit like they're clutching at straws already.
Good luck. Don't forget that any bike can break down and it's very possibly a common fault or one that could happen at any time.
Yep . But they sent a quite Sharp e mail . Because I asked on the forums if anyone had had similar.
And said we best give it back to you do fix....
Not friendly and not confidence building .
No update as how its progressing.

Because SV's never break down...
Apart from the reg rec, carbs, etc,etc...
If they let me know how they are going not be grumpy with me for sugesting a course to eliminate a cause . Believe me when I lost power several times round junctions.
General be nice as £4500spent is not pocket money
Then I could believe they are trying to fit it.
Also check the swing arm has been replaced if required and the fork bottoms are not cracked from overtightening the spindle pinch bolts on the RSV.

When I got the Vrap, Peg rode it 80 0dd miles home for me, as I was pregnant.
Next morning there was coolant everywhere.
Common problem with the radiator is theres a mount washer mod that was done under warranty as a recall thing. Some didn't get done, and mine was one of them being small mileage, and got lost somewhere between owners. Causes the curved rad to flex under strain from the hoses pushing on it, then springs leaks like a sieve.
Rang dealer, said I'm sendng it back on a Carol Nash breakdown truck. They weren't exactly happy, because I knew what was wrong and how to fix it, plus why should I pay for it, seeing as it needed sending off to a rad repair first, expensive, before it would need radwelding,
DavieSV popped in, to make sure they were being nice to my bike. They dragged their heels for three weeks, and Peg picked it back up...rode it home.....and it did it again, but I was expecting it!
If you are having issues, play up hell, as they really don't care once they have got the bike out of their showroom.....especially with them bloody highly strung Italian types:smt019
As for losing power round corners.......mine, and Peg did that once, overtaking a couple of 600s, bit embarrassing, but they don't like going below 3k revs, and sulk, so cut out sometimes, theres a few options to fix, but I haven't had the problem, mainly because I don't ride it like an IL4 and expect it to go round a roundabout for a sniff of rev! Try lower gear, higher rev than 3k.
The thing is iv not heard anything back.
LUcky deposit paid with a credit card . So have that as a last resort.

I had to get persistent with them, they were always busy, and wouldn't call back, which is why I managed to wangle a breakdown truck delivery, so they had no choice but to fix it!!!
keep ringing them until they cave in

keep calling them for an update.
is it from a main dealer with a few shops around or from a little independant type dealer?
if you are not getting anywhere with the staff in the shop try to go higher, sales manager, customer services etc expressing your concerns and lack of updates.
They are going to look at it next week.
Not very good customer care

next week???
how long have they had the bike back?
make sure that they don't try and fob you off that by the time they look at it the warranty has ran out!
Keep hassling them for an update and if you are not happy then give them a deadline for a result. at the end of the day they have had your money and you are without a bike.

I would imagine they would be looking at it a bit quicker than that. It's come out of their show room and you would think they would at the very least diagnose it?
Very different in the car trade .
Takes me about 1hr for most diagnosis that don't put on light.
Less when They do (5mins.)

If it was me, i'd be contacting them again, the least they could do is spend half hour investigating the problem that day/next day, and get back to you, normally you could book a bike in for something to be done in 1-2weeks ahead of the time easy, no reason why yours should take any longer, if they haven't begun to sort it after 2 weeks then step it up with legal action and press to get your money back one way or another. You've got to give them reasonable time to investigate/fix the problem but after that then there's no point being the nice customer anymore.
Ya its done apparently fule contamination .
Look out Esso .

Was it from crap fuel that has sat in the bike for a while before it was bought by you?
Its odd,Because it run fine cold? but thats what they said????
Oh and £198 pound for the cleaning 4 hrs labour and a re map to K and N and open cans !

Crap fuel would not cause issues when hot, IMO.
I cant be certain. And what with the tanker strike ,and all the goo it mixes up at the station . I'm going to have to take it on the chin.
Plus side ecm re mapped .
