View Full Version : No car tax - clamped! Advice Please.
I bought a car at auctions last Thursday, picked it up yesterday after insuring it, ready to tax today.
Trouble is at some point in the night some **** has clamped it blocking my wifes car on the drive so she cannot get off the drive and take my two young kids to where they need to go today.
I phone up and got £260 to get it sorted, of which £160 will be refunded on me turning up at the DVLA office with a valid tax disc for the vehicle.
I had no intention of evading taxing the vehicle and it was going to be the first thing on my list to do today...so where do I stand?
Is that just it? take the pill and get over it?

there is a lesson for you.you should have put the car on the drive with the wifes on the road. Question though "How did you get it home". My brother who is a regular auction buyer now uses trade plates as he got nicked driving out of the local BCA a couple of years ago.
Police and DVLA were waiting and pulled every vehicle leaving

Take your cover note, V5 slip, and reciept and explain that you've just bought the vehicle and were getting everything in order to tax it.
Sounds like a jobsworth with an ANPR has spotted and the change of owner isnt on file.
Yep right on the drive, moved it off to get the bins out!
I have paid and will tax it as planned today and go to the DVLA office, then I will have to appeal. I do understand that it was untaxed, but i had no intention of keeping it that way.

Yes.
If it was on the road with no tax then that's the risk you take. Does not matter if you meant to do it the next day.
If you drove it back from the auction with no tax keep quiet about it. Your insurance probably has a clause saying the vehicle must be taxed and tested or the policy will be void which opens you up to a world of additional pain.

Lesson learned. Expensive one too although I didn't think they could clamp a car over a drive when another car in on the drive.

That is an interesting point?
A car has to either be taxed... or SORNed... if it's neither then it can be clamped or impounded not matter where it is from my understanding.

I would see where you stand with them "denying you use of your property".
Then when you appeal mention it and see if they will let you off as compensation for that.

It does seem a little harsh but they have changed lots of their rules to suit themselves lately.

Thats proper rough pal, I dont know the legal etc but just offer my slowly shaken head in respect of how you must feel right now - ie gutted!
I hope you got the car for a bargain because that would really sting otherwise.
If you park in front of a drop kerb,blocking another vechles exit ,you have committed a parking violation.
It's ok if no ones bloked in though.

Just be glad they didn't tow or crush it.
My ex got his car towed once in London when he parked across a dropped kerb. It wasn't across a drive but the offence was that the dropped kerb was to allow those in wheelchairs and people with pushchaires to cross the road.

If you'd taxed it online then it wouldn't have pinged their automatic ANPR camera, which was fitted to on a mobile car somewhere, or went past your house, it would have showed as taxed, even though the disc wasn't displayed. This how they got you
Harsh lesson, but the rules are quite clear

which would've made it even worse, it wouldn't have been a cowboy clamping company, just trying to fleece him out of some cash, but an approved clamping company who are empowered to clamp un-taxed vehicles.
There would have been records made of of the car clamped and the reason why. To cut and remove the clamp would have cost him even more money

Yes that's fine to go with the new owner slip, or do it online.

I believe so. I'm guessing you have had the tax renewal form sent to you, on the form is a number that it tells you to use on the website.

Nah I havent received the reminder, tax runs out at the end of the month, got no V5 yet either. I suspect the dealer hasnt bothered to send it yet! Only had the car 3 months or so!
i would chase the DVLA up, it doesn't take 3 months for a V5 certificate

You can apply for V5 and buy tax at same time, V62 form maybe. If you tick box that you are a new keeper and never received V5 there is no fee for V5 just price of tax disc.
Think you can do this in post office.
I think the new keeper supplement is only valid for 1 month to get tax.

That's exactly why they take photos of the car clamped with the reg plate in view.

I wouldn't.
When you tax a vehicle online the disc is sent to the registered keeper. If you haven't received the V5 in your name it means you are not the registered keeper. Guess where it will be sent?

I'm sure they'ed be able to do something, dependent on what the Police were willing to pursue. Criminal damage in removing a legally applied clamp springs to mind. Although proving who did it, would be tricky, but then the Magistrates would look to the owner of the vehicle.
