right guys, a customer of my dad's is renting a property, the last tenant has left his motorbike there a 2002 cbr600 f, the guy was supposed to have picked it up a month or two ago when he got back from newzeland. now the customer doesnt know if he's back or not, but wants the bike gone. now can he go about claiming it ?

I've watched a lot of Judge Judy :D ... assuming US and UK laws are similar, basically a landlord has to give someone adequate notice to remove property. If he has given him written notice to remove the bike and he's not taken it, I'd say it's now his. Time to phone the DVLA me thinks.

but the customer is another tenant ( person renting property of landlord) so would he have any right to claim it?

track it or sell it for a profit idk, I've not had a proper look at it as its under a cover, but possibly keep it as a third road bike, as they don't look to bad.
but that's wishful thinking.

You must provide a notice stating that the bike, in this case, will be disposed of if not collected within 3 months of a written notice. A few things to note. Some landlord/tenant agreements have a similar clause written into them so check the existing agreement.

If no such clause, the property owner must make all reasonable attempts to locate the owner of the bike. If there is an existing address, email or phone number send the notice to the owner using these known details. If no known details, the landlord must prove that reasonable attempts were made to locate the owner before disposing of the goods.

Ok, here the tricky part. The goods cannot be disposed of until expiry of the three months but the person possessing the goods (bike) can charge storage and associated disposal costs. This must be outlined in the notice and must be reasonable. On expiry of the notice, the landlord can sell the bike or dispose of it to recover their costs (as outlined in the notice) but if you keep it, the owner can reclaim it if they return to take posession (usually limited to 6 years from the date of the notice).

Equally, if it is sold the landlord can deduct their costs but the owner is entitled to the difference if they return to claim the bike.

So the most realistic options are:

1. Send a letter recorded post/tracked email to last know address. Keep a copy of all correspondence;
2. Notice to outline costs and require recovery within 3 months;
3. On expiry, sell the bike and deduct any reasonable costs (storage and disposal costs etc);
4. The owner has a claim to any difference so keep receipts as proof of disposal.

let me get this right. your dad is the landlord and new tenants have moved into the property that the owner of the bike used to rent?

the new tenants want the bike moved out the way?

if all above are right then your dad has obviously got the bikes owners details so should be able to contact him.

here is what i would do. get your dad to get in contact with bike owner or if it's to much trouble for your dad then offer your services to track him down (repeated phone calls, txt's and emails) if you get a hold of him then ask what he intends to do about the bike. if he says that he is finding trouble getting a van/trailer then tell him he has a week to shift it if not gone in the week then you will shift it into storage and charge him the fees for doing so. or if you have the means to shift it for him then offer your services at a cost. if he says that he is a bit skint at the moment then offer him silly money for it as long as he still has the documents if not then offer him even less. or you could be a good samaritan and shift it for him since he is a fellow biker (not that that has much meaning nowadays).

No my dad is just there window cleaner haha. It's a the tenant/customer is a friend of his, I don't have a clue who the landlord is. Mark ( customer) said he will message guy and see what he is doing with it.

Just as a side note, at the beginning of the year my backpack opened on an A road at silly speeds and spewed it's contents over it for the next 10 miles. After pulling a u-ey and heading pack to pick up my smashed belongings, two different sets of people stopped at two locations. Both bikers but in vans/cars, both checking I was alright since I was parked in random places and walking in and out of the road. I was quite surprised.

Biker spirit in full flow there, although I don't come from a horrible nightmarish part of the country like you Bibio. :mrgreen:

The exact same thing happened to me. Biker spirit definitely alive and well down this way.

I would just like to say the event in question happened closer to Winchester. Had it happened in Basingstoke I probably would've been stabbed the first time I got off my bike. I don't ride fast for fun. It's for my own safety.

yes its crap up here. the roads are empty with lots and lots of twisty bits and people actually speak to each other, our beer is crap as they are now brewing most of the stuff we get down south which is made from pizz collected from cat and dog homes.

Know what you mean Bib, it's truly awful here in Northumberland. If I was a southerner I'd never come up this way, horrid place.
