I'm in the process of sorting out a claim against a dozy mare who drove into my bike while it was parked.

I have legal cover as part of my insurance, so I want to claim off her insurance, rather than make a claim on my fully comp policy.

I just wanted to query the process for (hopefully!) receiving the payment.

The solicitors who are acting on my behalf have included in their letter to me:

"I confirm that I authorise xxxx Solicitors to act on my behalf in the recovery of the losses that I have sustained as a result of this accident.

I also give my irrevocable authority for xxxx Solicitors to clear through their client account any cheque(s) payable to me in respect of the uninsured loss claim arising from my accident dated xxxx 2012".

It's that second section that I'm not sure about. Is it standard practice for the 3rd party to make a payment to my solicitor, and for the solicitor to then pass the money on to me - rather than me receiving a cheque directly?

Any knowledge / experience of this would be appreciated. Thanks!

That looks like a fairly normal solicitors Terms of Business. Don't worry about it.

It is not an unusual practice,BUT ---it can sit in their account gathering interest for a few days, weeks before before they issue a cheque in which case you are entitled to the interest.
By doing it the way you are might be a bit longer winded than claiming off your comp insurance.
Surely as you are claiming anyway it would be a Non Fault claim and not affect your bike premium.

Insurance do a "no claims" not "No Blame" discount.
So your loose that discount unless its protected.

Slightly different scenario, but when I got knocked off my pushbike. I claimed off the drivers insurance and ended up getting a solicitor onto the claim. ( Long story dont ask )

Is how my payment arrived, it came in the form of a cheque from the solicitors themselves, rather than Mr Magoo's insurance company.

Ask Ed about how strict the regulations are regarding solicitors client accounts...

But if they recover their costs from the other party you get the No Claims Discount back.

Not every time . Depends on insurance company.
My sister got stuffed by hers when a builder backed into her car.
Stick it out with the solicitors .
