If I sued all the places where I worked, and tripped up, I could have retired ages ago.

Its dark, so she's got an official issue torch to chase baddies, in case the run way, so why wasn't she using it?

Thats the basis of her claim, the garage forecourt was poorly lit, causing her to trip on an unlit kerb.

Our risk profile for this kind of work would be to use a torch in the absence of good illumination

Crazy state of affair I think.

Does this mean if a Police Officer breaks a finger nail whilst searching a vehicle, they can decide to claim off the driver or owner of the vehicle? :D

had some bull**** at work last week about stuff like this saying we have to put barriers in front of the diggers when not in use because someone walked into one of them, we all replied with open your eyes then same applies to this

I like to put cones In front of my barriers incase someone doesn't see the barriers.

I am however at a loss as to what to put in front of the cones incase someone doesn't see them.

I would imagine that will form part of the defence, its a kerb and should be expected in areas regardless of lighting, the same could be found in any public place.

Hopefully this goes to trial and gets thrown out because that sets precedent.

Also being reported on the radio news, complete with a gormless sounding numptie from the Federation saying everyone is owed a duty of care by premises owners, regardless of their job. I'm sure the Federation must perform some useful function every now and then but this also puts them down in everyone's eyes too!

I'd like to see the Fed rep try that in my work area.

We also have the same type of numpties who for the rule book religiously, we HAD to do a first aid course, because the Union guy said we had to, even though we're trained to First Responder level. He had our version of the rule book to quote from.

They are right so far as it goes but not where you have a perfectly normal thing like a kerb.

If the WPC had tripped over an unsecured pump hose that had been stretched across the forecourt it would be different but she didn't.


IMHO it's like me banging my head whilst working under a table. Can't expect the premises owners to cover it in foam.

I find it hard to believe there is'nt more to this than tripping over a kerbstone.On the face of it there is no case and the whole thing is insane.
Having said that we should not forget that police are no different to any other workers,and they are entitled to exactly the same protection from hazards as any one else.After all,if they get injured or sick they get dismissed just like anyone else so they should be able to seek compensation like anyone else if they are entitled to it.
Probably not in this case though
