No, I'm on my mums will, as is my brother & sister, so probate should be fairly painless.

Depends if there's will & how it was set up

Going through the process at the moment with my mums will, BTH, letting the solicitor do the hard part. Actually getting in the funds etc we are doing ourselves to save cash.

An ex tax inspector (family friend) did my dads for me (but he has since died himself, it doesn't have to be a solicitor.

Ok well looking at dad's papers I have found a policy that had statements up to 2007, but nothing after (that I can find).
It's no small amount of money and had no response from Prudential in the last week and half other than one pay out for the funeral cost.
Dad had a ECC pension that want probate to give mum a percentage of his original.
But you need to fill in the inheritance tax form to apply for probate.
As it's only £35 k,and most of the assesets are shared his under the threshold even if the policy is live.
Can you go back and re dress the tax declaration after application and submission of the tax forms

I sorted probate and IHT on my parents estate last year, banks will release funds for funeral expenses and IHT before probate is granted but probate and IHT forms have to be submitted at the same time. If the estate's value is below the IHT threshold of £325,000 than it's unlikely you'll need to fill in the full set of IHT forms, just IHT205.
