Ey up all,

Posting on behalf of one of the guys in the hope to find some solid advice from our law enforcement members.

He dropped a cig butt in a bus queue in Leeds City Centre on Wednesday and was fined by one of the civil enforcement officers for doing so. He feels he's been fined unfairly as he approached the officer to ask where the nearest bin was and he was advised just to drop it. He done so and was given a fine.

The officer was wearing a video recording device, so this is all on record should he wish to dispute it. In my eyes, he's followed instructions issued by a figure of authority so should not be fined.

On top of this, the fine has been issued to the wrong postcode (though he gave his correct postcode when asked, and produced ID).

I don't think it stands, but would like to know for sure?

If he was told to drop it on the floor, then issued a fine thats clear entrapment. The "officer" has a vested interest in giving him a ticket. Thats his job.

I agree with ya, would just like to know the legal stance on this. For the time being he's ignoring the fine - but if action has to be taken, he shall take it.

Isn't there an appeals process on the ticket?

If so I'd be inclined to write to that and explain.

I believe his name and number were on the ticket. I'll get the lad to check it, but I'd imagine so.
