Ok. Anybody had a really bad speeding ticket with reckless driving as well before? Just wondering what I have to look forward to or what plan of attack I should use.

Thanks.....can't you just lie to me and tell me everything will be ok. Just kidding. Yeah that's what I thought was going to happen. I have to drive a lot for my job and that is not an option. Maybe a thousand bucks can get me out of it?

If it were me, and my job depended on my licence, then I'd sell the bike before the court appearance to show the judge that I was truly sorry (yeah right :twisted:) and had given up biking for good. Might help just enough to get a big fine but keep you on the road - you can always get another SV a little later.

I got done in NC , albeit driving a VA registered car (stang 5.0 :evil: ) along highway 12 (gorgeous gorgeous road and scenery) , doing 90 in a 55. Anyway I ended up getting fined $400 and that was that. Expect a hefty fine I'd think and not much else. The reckless driving crap in the states is just for doing 30 over the posted limit? correct me if I'm wrong; I'm sure it varies from state to state but that was the case in VA. Mine was also issued on the ticket as reckless but nothing came of it I just paid the fine.

If you have no prior incidents on your record, bring a certified copy of your driving record to court. If you do have prior speeding, other serious offences (e.g. past DUI), or are young, bring an attorney to court. An attny who specializes in traffic law not only knows the judges, but also the prosecuting attorneys - probably by name. They may be able to plea bargain with the local prosecuting attorney before you even get to court, giving you an additional chance, other than just the one shot at what the judge says.

If you have no prior offenses, a long clean driving record, and you can speak with the PA before court (call and see if they will speak to you the day of but before court -- not all will especially if you are not a lawyer yourself) you may be able to plea bargain a big fine and getting the charge dropped to "improper driving" or something similar. Find out what the law is in your state so you can say "I would like to trade this infraction for this specific one..."

Get to court really early. If you don't know where the court is, go there once before so you have a plan for parking and don't get lost. Judges tend to frown on tardiness. Dress nice in court, but not too nice. Suit coat and tie, but not matching suit pants. Wear nice trousers but You don't want to seem rich. Be polite, look the judge in the eye when you speak and are spoken to. It also helps to look uncomfortable and nervous before the judge. That will likely be the easy part...


Oh, and Virginia's reckless driving can be doled out for merely 20MPH over the speed... Don't ask me how I know that... :-dd

Oh, and find out if your state sometimes gives out driver training classes for traffic offenders. Maybe taking that class before getting to court and bringing proof of attendance etc might better your position.

In the UK, 30mph over the limit is normally a ban, 50mph over can result in a prison sentence :shock: Plus the fact you're a biker won't weigh in your favour :!:

the best way is to try to get out of it.i got a ticket doing 115 in a 55 in a car and i went to court and told the clerk i wanted to fight it by written declaration all this mens is that you write the judge a letter saying that you dont believe you wre going that fast and you feel the cop was wrong.if you fight it in court and the cop shows up you lose[they get paid to show up].if you fight it by written declaration if the cop dont write a letter to the judge[cops dont get paid to write letters on their own time]you get off.in my case i got a letter a couple of weeks later saying my case had been dropped.even if you dont get off this will buy you at least another month or so .before you write the letter to the judge call your local county and ask them when the last speed survey was done on that road if they sey they dont know then put that in the letter because they are required to do speed surveys every so often .hope this helps

Thanks for all the help. I am trying to get a freind of a freind in the NC Higway Patrol to help me out a little. Keeping my fingers crossed and the bike is already listed for sale in the paper. It breaks my heart to sell her. I have owned it since it was brand spankin new. They had to put oil and gas and a battery in it.

But if I keep it I will probably wind up in jail or dead. So.....I guess its so long to street and riding.

I would love to keep it really. It seriously is gonna drive me nutz not having a street bike. Especially after putting all the time into turning wrenches and tweaking the bike. Actually that is half the fun to me. But I ride WAY to agressively and I will be the first to admit it to anyone. I seriously think that I would only get into more trouble or injury if I were to keep it. It's really nice. Hardly even looks like or drives like a stock SV anymore. Oh well.

But thanks for the advice everyone. I would love to stick around the forum if you'll have me after betraying the SV name and selling my baby.

One idea would be to "sell" it to a trusted friend and then "buy" it back after the case... One of my customers did that when she got busted on her GSXR thou.

Over here, a friend of mine undertook a car doing 100mph, at about 130mph and pulled in front of the car... which turned out to be an undercover police car.

He only got points and a fine as he got his work to write a letter about how he had to keep his licence for his job, had been rushing for something job-related... judge said he should lose his licence but he'd give him a chance.

Would something like that work in the US? Judges are judges...

Not sure if you guys have anything like it in the States, but here there is company called X-Copper. Basically they are ex police officers who go to court with you and help you win the case. They aren't cheap, but then again neither is the fallout from a big speeding fine. They helped a friend get out of an avadeing (terrible spelling) charge, as well as careless driving. Might be worth looking into. Good luck though. Alot of times the officer doesn't even show up to court, and the charge will get thrown out. (here in Canada anyway)

WELL WELL WELL..........The jury is in and all charges have been dropped! To all you guys who wished me luck and gave me ideas. I thank you for your support through these hard times. :lol: And to all of you who said I was screwed....Well you can suck the dilznick. Just kidding.

But seriously I got off. I found a friend of a close friend to pull some strings and whalla. I know I am just extremely lucky though and thank God for allowing me to find a way out. I have learned my lesson and will save the fast stuff for those track days. But oh how those track days are so few and far between, and I live in the virtual race track. The famed Appalachian mountain range with its twisties. My fav is the Dragon's Back. It's 318 turns in 11.7 miles. It's mind bending. If your ever in the Western NC area look me up I'll show you where it is.


Now the question is do I sell her? I know I will eventually wind up in the same situation again with no way out next time.

What do you think?

Ladies and genetlemen, corruption at its finest :) Nice one mate!

This might not work for you, but one thing I'm really aware of, epecially on open roads, is letting my speed creep- I don't set out to speed but over distance it always, always creeps up. But last year I got a Veypor, which is a really cool toy but has one feature I find incredibly useful day to day- you can set the gear shift light to act as a max speed light instead, so it comes on when you pass a preset speed. So if I'm going to do a lot of motorway bashing I'll set it for a speed that suits (not neccesarily legal, but low enough to keep me from big trouble) and if the speed does creep, a nice bright red light shines in my face and says "Slow down, idiot"

It might not sound like much but that could easily save my license one of these days, especially if I start doing more motorway work.

Other than that, the answer is just use restraint. The jury's out on whether trackdays help keep you legal on teh road- some people manage to keep their high-speed playing to the track, others find they ride faster off it once they get used to track speeds. It might be worth finding out what sort you are if you don't already know.

Thanks for the advice North but I think I will still sell her wait a year and then go get a 1000. Test drove one about 2 months ago and 3rd gear wheelies were just a flick of the wrist away.

Probably won't help my ticket problem though.

Yeah......but I seem to have some bad luck when it comes to getting caught. Although I would have to say that the way I ride the ticket I got was well deserved. That's why I am set on selling my baby. I can't get my license taken if I'm riding a dirt bike in the woods.

Maybe in a couple years when I grow up (I'm 27 by the way) I might be mature enough to get a litre bike and not abuse it. Yeah right! :D

This can work to your advantage.

I would go and take a look at the opportunities for suing the:

- local highways council/commission/whatever for not marking the road signs correctly
- Suzuki motorcycles for not overtly stating that their motorcycles can exceed the speed limit on US roads (this would make you extremely unpopular with the biking fraternity)
- your motorcycle training centre for not training you properly
- all other motorcyclists in America for giving you a false impression about safe motorcycling speeds
- the police for causing undue mental anguish over your 'capture'

Anyway, thats just my 2p...

Now your just being silly.......Seriously I understand that America has a reputation for suing at the drop of a hat but, I don't think I have that much time on my hands. I would have to quit my job to devote all my time to ambulance chaser's.

I should move to Europe and just play dumb. When I get in trouble over there I will just say I'm an American and I don't know any better......Think it will work or just get me locked up quicker!

Kev, I agree with you on this my friend. Sell the bike to keep your license and job. Your young enough to wait 2 or 3 years before getting another bike for the road. Like you said you can still play in the dirt and keep your license. 8)
