Well I was just planning to service my bike today for the sv rideout :D . That was until last night when on the way home from work i stopped at the junction put the women behind carried on taking me and the bike into the junction. :( not a happy bunny. I came away with a bruised shoulder and neck plus a broken helmet. The bike gear hanger got snapped a chip out the frame, a small dent in the swing arm some how as its under the brake line and wheel that no longer goes in a straight line. Not to sure if its a wright off or not. But hears the best bit my insurance dont seem to care as other driver has admitted fault and told me phone her insuance and have it out with them unless i pay my excess and lose my no claims BAST**DS . Phone her insurance coimpany and they said they will get claims guy to phone me monday i feel like im getting the run around. So with the damage so far is it write off or not im just worried about cracks in the frame.

What insurance do you have? Comprehensive or TPFT?

If TPFT then the insurance companies attitude is pretty normal if comprehensive its reprehensible.

The proper proceedure for Comprehensive is, you make a claim and the insurance company fixes replaces your bike, you have to pay the excess and then you calim that excess back from the other drivers insurance. You insurance company claims its losses and once paid your no claims, which will have been suspended, is re-instated.

Write off :(
No doubt about that, with damage to the frame.

Ending up in the middle of a junction doesn't sound like fun.

Bugger, glad you're ok.

My GPZ was written off for a lot less so you may have a problem. What patch says about the insurers is right if you are fully comp you can get your insurers to deal with it then claim it all back but if she has admitted fault it may be easier to go straight though her insurance anyway, At least that way you don't have to temporarily fork out your excess.

Did it happen in Brum? Where about?

My previous ones were supplied by the opposing insurance company. Easier if fault is admitted

Similar thing happened to me. Mr White van man reversed in a busy street and parked his van on top of my lovely little 125 crosser   . being a skint learner i could only afford TPFT.
No joy from my insurance and took 6 months to sort out a replacement bike. they offered me £1600 for a 2 month old £2500 machine. Needless to say i told em where to shove it :x .
luckily i had a old for new scheme on finance so got a brand spanker.
Next time i'm going full comp (couldn't afford it this year again)

Glad your okay thats the main thing.

If she has admitted it in writing then its off to the "No Win No Pay" Solicitor, they will love to take the case, cause you do have injuries.

thanks for the advice. Creamerybutter is happened on the A446 island where you csn join the M6. Just come off the phone with my insureance agian different department and will give me a courtsey bike for £1 a day and deal with my claim they just want the other driver reg phone number and address. One problem the other driver is worried about giving me her address

I could be wrong but I think ou can get her address fairly easily from the license plate? maybe it's a police-only thing but I've seen it done on VD. Registered keeper search through the DVLA IIRC...

 Damn, lucky to get away with so few injuries.

Worried or not I think she's legally required to give you her details. I know she's required to give you her insurance details, but I think that applies also to her address. If Im wrong Im sure someone will correct me.

Not sure of that junction.

All your insurance company really needs is her Name, Reg and Insurance details for now.

If there is anything I can do what with being fairly local and all just let me know.

I've used HelpHire when I was hit by a car (I was in a borrowed car at the time). helphire, or a similar specialist solicitor should be able to sort this out without you claiming on your insurance - though you must still inform them.
They should make sure that your bike is repaired or replaced, and that you have a suitable courtesy bike - for as long as it takes for your own bike to be replaced.
They should also get you compensation for your injuries.

HelpHire were very good - but I don't know if they do bikes.
If they don't I'm sure there are companies to help you - especially in such a clear cut case.

Good Luck

I think im winning slowly. After phoning my broker and told them what the insurance company said they went mad  . Now someones comming round to see the bike to estimate the damage worryingly its an engineering firm not bike engineer so I surpose his guess is as good as mine and the solistors are phoneing me tonight to discuss recovering costs helmet, leathers, gloves, boot and personnel damages. One problem though I love my SV but I hope they write it off as I have had cars fixed after bumps and they never feel right so either way, write off or sell it I wont be ridding it again.

glad youre ok.

I only had tpft on the cbr [fc on the sv] and Ive had good service from my insurance company. They sorted the courtesy bike, theyre dealing with the tp insurers and updating me...

tbh, if youre insurance company knows its fully not your fault they should help you. get back on to them and kick them up the backside. A no fault incident shouldnt affect you ncb on the grounds all costs should be recovered from tp insurers and you shouldnt be affected by your excess. :?

Just had the insurance man round to view the damage to the bike and has said i should get an answer in the 3 days if its a write off or not.
This his list of repairs -

1) New frame
2) New swing are
3) New left side fork
4) New number holder and holder
5) New Gear hanger and foot peg
6) New rear view mirror
7) new crash protector? (Last set did not seem to work)
8) lower fairing left hand side.

I got a quote for these repairs from my bike dealer and they think part and labour about £5000 should cover it. So could chance of a right off.

So i might be selling the extras i brought for the bike and get a new one , just dont know what to get yet??

1) New frame

I may be wrong, but isn't that a new bike?
It's a write off. Any damage to the frame always means that.

Interesting what's been said about differences between speaking to the broker and the actual insurance co... broker I contacted after getting knocked off (Bennetts) did all they could and were really helpful, etc. but the insurers (Equity red star) were pretty inefficient and unhelpful... I wasn't even claiming anything from them but they were asking for loads of forms to be filled in, asking loads of details, etc. and then came back about a month later saying because I had tpft I wouldn't be able to claim anything from them  twonkers! Always best to go through the broker and avoid having to deal with the insurance company itself in my opinion :)
