Well, I walked out of the hospital anyway.

So commuting as normal this morning and as I go along Selhurst road doing about 25mph towards South Norwood, I go over a cross roads and then I suddenly see a car on my side of the road coming straight towards me. There was nowhere to go so we collided head on.

I remember somersaulting through the air and landing on my back. I know nothing about first aid except you aren't supposed to move after an accident so I didn't. Luckily a first aider appeared pretty much immediately and looked after me.

The guy who hit me was asleep at the wheel.

He didn't slow down at all, just veered onto the other lane and went straight into me. I didn't even have much chance to brake either.

Anyway, got picked up by paramedics and taken to the hospital and they checked me over. Btw, neck braces are really not comfortable. I was given pain killers and told I could go home so I did. Kindly Joe and our own Squirrel came and got me.

So I have whiplash, heavy bruising and strained ligaments and tendons etc. Ow. Good thing I'm not a guy as I got slammed into the tank but damn, it still hurts if you a girl. I won't be getting on a bike for a bit.

The good news is that it seems at first glance that the SV will be ok. The front end is pretty totalled - the forks are bent back forcing the front wheel up against the engine and the front fairing is pretty much non-existent. But all repairable.

I am thinking about using some other form of transport for commuting now though. All my accidents have been when commuting, maybe its time to take a hint, will have to see.

I have a hire car already arranged for tomorrow - a Corsa! lol

Yep thoes neck braces start to hurt the back of your head and chin after a while.

Damm, sorry to read this. Injuries should heal after time but don't be suprised if they last. Get a good solicitor to persue the damage to your bike, injuries and the uninsured losses such as helmet, leathers etc.

Sounds like you have some good people looking after you. So put your feet up for a couple of days and milk the attention whilst it lasts.

Oh yes, after wandering around the accident scene telling people that he was asleep at the wheel, he decided he also needed to go to hospital for back pains.

He ended up in the bed next to me and he was snoring. Could not believe it.

The police were at the scene and got statements and also came to hospital too. They have him and will be charging him with 'driving without due care and attention'.

Apparently he passed his driving test last month and this is the second RTA he has had.

Unbelievable.

Jeees Kate! Glad you're okay! The possibilities just aren't worth thinking about - you're very very lucky!

Write the bike off... for goodness sakes! It'll be his insurance, he'll be done for Drive Without Due Care... surely the collision will have knackered your forks and then some! Make his insurance pay - you shouldn't have to put up with anything less.

On the other hand, why do people not realise that every time they get in a car, on a bike, a van, truck, whatever... they're taking control of a lethal weapon. Negligent *&%$~)*

Kate... I'm very glad you're alright.

I am not backing him up, the sorry fact is that some people are not aware that they have it, along with some people that sudenly get fits. Thats why it will have to be diagnosed if he has it or not.

They will have to make sure of that now.

This is not to say that he was driving tired and fell asleep then its his fault completley and should get banned for a long time.

Whichever way, hope it gets all sorted out without any lasting damage.

I think the bike will write itself off in this case. New front end, plastics and lights no doubt, pegs and levers etc. plus a lot of smaller things you just don't realise unitl it's stripped. I'd be astounded if the insurers paid out for a gsxr front end instead of returning it to standard.

Make sure the hire company record the mileage when they deliver. This might help in a personnel injury claim as proof you were not fit enough to drive the car if you get my drift

Hi Kate,
Glad you are O/K. Get a personal injury claim in and claim for all your gear etc. Keep notes of anything people have done for you, you can claim for all sorts of things. A good solicitor will advise you, my wife had to keep a diary of how it affected her, even mundane things like not been able to do her own hair! Work and DHS will possibly claim loss of earnings and sickness benefits back from him.
Glad I do not have to commute in a city any more. Take it easy.

v scary that someone can fall asleep while driving in town. oh, and who the hell can happily doze off to sleep in hospital after causing an accident like that?? I'm with the smothering suggestion...

Diveboy
04-02-06, 10:26 AM
I know this sound petty but if you are going to put in a personal injury claim you need to keep track of everything you buy.

If you need a pain killer buy a new box and keep the receipt, don't use ones you have as you can't prove you bought them. This is what my mate was told after his accident.

It is possable he suffers from Narcosis.

I was just thinking the same thing. I think diabetics can have similar problems.

Diabetics can of course go hypo, and basically pass out. This really only happens with insulin dependent diabetics - which is of course a condition that should be reported to the DVLA.

Ricardo, mentions narcosis - that's a tired state caused by a lack of oxygen to the brain. It can happen to people at high altitudes, or deep see divers with poor oxygen mixes. I think you got the terminology a bit wrong...

What you mean is Narcolepsy - this is a condition that really has to be seen to be belived. I was at school with a guy who suffered from this. Simply, you fall asleep. You've no control over it whatsoever. When I was 13, it was amusing to watch this guy writing notes neatly in his excercise book... and watching the sentence trail into a line off the side of the page as he fell asleep. It is treatable, but is a very serious illness.

Of course, it's rare, and I don't believe for a second that this idiot suffers from it. As Kate says, a "heavy night" is no excuse, and rather unforgiveable - I hoped they breathalised him and found him still over the limit as well.

Professor

God almighty! Glad you survived, Kate.

You should certainly get a personal injury lawyer working on your
case.

jonboy

People with narcolepsy, of course, aren't allowed to drive. I think it was very much "the morning after the night before" and this isn't excusable.

hi again kate. hope you arn't feeling too sore today. dont worry about work, let them stress out and you get yourself together. talk plenty about it as at some point you will need to offload.
do yourself a favour and keep a diary of incident whilst fresh in your mind. keep a record of all doctors visits etc (they will keep details on record if you need them) and any after effects no matter how small.
i dont mean to sound too depressing but it really helps to talk in these situations. keep smiling kate, just ask on forum if you need any advice at all. :D :D :D

Hi Kate,
Maybe worthwhile putting the original exhaust and bits back on the bike before the insurance assesor looks at it. If the exhaust is not road legal they may try and limit the pay out. Also if the bike is written off you have the bits for the next one or you could always sell them

Kate

Glad to hear you're relatively unscathed from what could have been a very nasty situation.

I can only agree with the posts recommending kepping a diary.

I had my accident in August, but it was November before I had the official medical assessment - it's hard trying to remember how long it took before I could do various menial things. Apart from the obvious 'How long before you went back to work', they're interested in stuff like:

- How long did it affect your ability to wash/dress yourself?
- How long did it prevent you from doing normal household chores?
- How long before you could ride/drive again?
- What was the affect on your mental state when you resumed driving/riding (i.e. were you unduly nervous, or as you've mentioned, unwilling to commute by bike anymore)?
- Were you depressed/down following the accident (quite common if you can't get around by yourself)?

If you're going to take any photos of your injuries, make sure they are recognisable as you, i.e. include your face in the photo. I didn't do this, and the doctor filing the report was not permitted to look at the photos because I could not prove they were of me.

If you have any lower leg scarring, wear a skirt to the medical, then it stands more chance of being recorded as a visible scar.

Also, if you have no recent medical history of back problems (or other problems relating to the site of your current injuries), ask your GP to write a letter confirming this. The doctor who did my assessment did not apply for my medical notes from my GP (I'd just assumed that she would), so she only had my word for it.

Insist of private physio paid by the insurer of the other party asap. I didn't push for this and have only just started my physio some five months after the accident.

Sorry for the long post, but I've found the whole process of claiming for injury and personal losses to be extremely long-winded and frustrating.

Most of all, take your time, and do let your friends and family help. Here's hoping for a swift recovery.

Take care

Jo

The tomato plant is doing well! (I haven't killed it yet, but give me time).

Poor Joe has been a star looking after me and putting up with my complaining

Well, still hurt quite a bit but as long as I don't move too quickly nothing is jarred so easy does it I guess. Am trying to get an appointment at my doctors but its proving a mission in itself

I don't think the bike is a write off, I'm having a go at sticking pics below courtesy of Jambo and the general opinion is that its all fixable. Haven't had the official estimate yet though.

Take care and my best wishes, and I hope you get a nice new shinny bike!

I've not floated over to these parts much in the last few months, but I'm very glad to hear your injuries are minor considering the possible outcomes..
Hope you GWS

Poor Joe has been a star looking after me and putting up with my complaining

I don't think the bike is a write off, I'm having a go at sticking pics below courtesy of Jambo and the general opinion is that its all fixable. Haven't had the official estimate yet though.

Nurse Joe <shudder> Now there's an image I really didn't need!

When you check the bike over get someone to look at the front of the head. The calliper bolts have a tendency to stamp nice holes in the head or cam cover (or both). Very hard to see unless you are on your hands and knees looking up.

Glad you made it in one piece anyway!

Hi Kate. Sorry - only just seen this - had no idea!

What a horrible thing to happen.

I hope you're feeling much better very soon.

It must have been horrible! I had a near miss at a head on when some tit tried to overtake another car and it scared the crap out of me. Glad you ok and that guy deserves to loose his licence.
