I'm to start a new job with Fujitsu on the 30th of this month, but I've been offered another job which I would like to take instead.
Now I've signed all the paper work with Fujitsu, so can they make me work a months notice, which I would rather not do or is there something I say to them.
I have called and let them know whats going on, just waiting on a call back but it would be nice to know mine and there rights.

As far as i'm concerned, you signed paper work stating you start on the 30th. Therefore you dont currently work for them so and further stipulations shouldnt apply.

if u have signed the contract then i do believe u have to work the notice asked for in the contract. but u maybe be luckly u you plead your case.
but as i say leaglly i would say u ae bound to the contract. not sure tho

Grinch... do you not have a probationary period? I'd be amazed if not - for their protection and yours! It allows you to get rid of them easily, and vice versa.
Your employment is not effective until the 30th, and only then will the contract "start". Tell them as soon as possible that you do not intend to start the position - you can then avoid any tedious gaps of employment history on your CV, as you certainly won't want this job on there if you're only going to spend a few weeks in it!

I did law at A-level, and well it looks like relly you should work the notice, but they could agree to let you off yet anyway. I hope so *fingers crossed x
Yeah but if his contract start date is 30th May and he's not started yet then surely he doesn't need to work the notice... oh well what do i know

Well I've given them notice today, so that would be the 1 week! So maybe I don't need too :?:
If you've signed off on the contract, then you have agreed to start on a particular date. Technically that means that if you don't start then you're in breach, they can recover damages - as you could terminate on a month's notice it'd be the cost of hiring you, and also any extra cost in hiring someone else for that period. There are some fairly complex rules about mitigating loss too.
But realistically I doubt that this would happen - they might be a bit ****ed off but most employers would accept reality. Or ask you why, you say you're getting more money, they don't want to lose you so match the money. A company like Fujitsu is most unliklely to try to get anything back off you, it's dreadful PR and shows a failure of HR policy. Yes technically they could try to recover - but I wouldn't worry about them too much if I were you.
Well I've given them 2 calls today, just to let them know. Though the HR person is getting hold of the hiring manager they did say I shouldn't worry to much as they don't expect me to start.
They did ask if there was anything they could do to keep me, but I don't think it will be in my interest as I'll be on the 40% Tax bracket and will need to be rather a lot to make it in my interest. Plus the IBM job is another 10 miles and about 10 sets of traffic lights closer.

Lol.. to think when I was 23 I was still on 13-15k, and the year before I was earning so little I didn't even get taxed. Got some back! lol... Then got a job at IBM... and bang, 24k...

Call them up and tell them that you'll work the notice period, but you'll sabotage absolutely everything you touch for that time, so all in all it would be better if they let you off.
Well finally got the info from someone in HR and they said as I haven't reached my start date it should be all fine. I'll just get a comfirmation letter though the post. So I start at IBM on the 5... so a little holiday for me.

I was told that for UK salaries, you can consider courself as "doing well" if your salary equals your age x 1000... I'm 32 so ideally I should be on 32k. Damn, I'll have retire just as I hit the big time (65)!

Unwritten law of personal finance - your 'outgoings' will rise to meet your 'incomings', + a bit :roll:
so you'll always be broke regardless of what you earn :lol:

unless you get the money taken out sharpish. atm i split my disposable income in half and put half where i can't get to it......
or we have a sharesave scheme which steals the money out of my pay before it even hits the bank

Emm, I know that Trampie's other half is a union man concerned with employment law. Might be worth a PM maybe.
This isn't really an issue. If you just failed to turn up there's no company in the world that's going to pursue you for breech of contract. It'd be more time, money and effort than it's worth.
I've had a couple of recruits do this and all you can do is shrug your shoulders and get hiring a replacement.
My advice is: ....

Though whose fault exactly its hard to say. The department wanting IT on the cheap and losing many man hours in lost time due to not being able to do any work since they computerised it all, and for not paying up front, or Fujitsu deliberately understating the costs to win the tender and then struggle to go a week without some issue where I work, let alone the rest of the department.

Aged 21 £15k + commission
Aged 22 £18k + commission
Aged 23... £24k + annual bonus + shares
Pay review coming up in 2 months, im asking for another £2k.
Always thought i was behind on the pay side of things.. but wow.. perhaps not - seem to be doing quite well.

Yeah we got paid when we raised the issue. Apparently, it was something to do with a **** up with BACS - something caused by HSBC?? Heard it from a friend who works for Finance in NU, as they suffered the same thing with transactions going through on BACS on that date.
As for cash, we've just managed to secure another £5m investment, Boston USA office opens in July, and things are looking up. As for the raise, im not pushing it, im just going to raise the issue. Doing it in the form of a small presentation my manager, our Finance and Operations Director, in which im outlining the advantages to my employment and what i've brought so far to the company, and what i have to offer in the future. After all, i just brought a deal to the table (a lead i got off my old man) which is worth a potential £600k to the firm over the next 12 months, im sure they can afford to give me £2k out of that. :wink:

You know, I dont think he'd disagree with me that in some areas its absolute pants.
Besides, he gets paid to ride his bike. I dont think anything else really matters :wink: :P :lol:
