I have a slight problem:
I sold a mobile phone at the end of may, it was damaged but it was only cosmetic and was fully detailed in the auction (with detailed pictures). I tested the phone literally 5mins before I boxed it up and it worked fine.
Anyway the buyer bought it and left me positive feedback and now nearly two week done the line they have messaged me to tell me it doesn't work.
Obviously I want to help them as much as I can but I was wondering officially what do I have to do? Will I have to take back a phone that was working when I sent it? Will I have to refund them fully?
I have tried contacting paypal/eBay but they don't seem to be to quick getting back to me. Just wondering if anyone here has any experiance with this kind of issue?

Hmmmm - Tough! It's taken a drop after two weeks and they're blaming you now? Trying it on - ADVICE to eBay buyers -Don't leave feedback unless the item is checked properly and DON'T take the ****.
Been using eBay for years and only had a couple of niggles.

Its an auction, if the product was as stated when dispatched hard luck on them and why has it taken two weeks for them to find out??/

Did you offer any warranty, No didn't think so. So tough on him, you have nothing to worry about.
Yep, agree with the above posts. I presume you wouldn't have been given positive feedback if the phone HADN'T been working, so I don't think you have any need to either feel guilty, or help the person out.
Anyway, they could have broken the phone themselves and just be trying it on.

It's a little harsh, but they're right. If you'd hidden any defect, that would be different, but caveat emptor. If you buy used, privately, you have no recourse if it should subsequently fail, especially when there's no evidence that it was faulty.
You've got your money and they've left feedback? End of deal move onto next one.
You'll only have refund them when you say that you will, usually 7 days on ebay.
They may complain to paypal, but I doubt they'll do anyhting. after all it did work for a whole 2 weeks, so nothing wrong with the way you listed it.

not the case i am afraid there is a little known thing with paypal called a merchant chargeback. i fell foul of this one and am still in dispute with paypal over it.
check the details of the paypal transaction , was it spp as in seller protected and a verified user and did you use a tracking postal service ?
a merchant chargeback is where the buyer disputes the credit card transfer with is cc company and in my case i got stuffed with a negative balance on paypal and it's still not sorted yet.
long and protracted case but having the money in your payapl account does not mean an end to it believe me.
if the transaction is covered by the seller protection then ignore all the above :shock: :wink:
hmm yer if you didnt offer anything in your return policy then your fine dont wory but if you did then i guess you will have to gove refund.

This is what I am worried about, although by the look of it it is covered by the spp what exactly constitutes tangible goods? Also I sent it special delivery but as I had +ve feedback two weeks ago I could have binned the slip (I don't usually but i can't seem to find it).
Ask them what they want you to do about.
Be polite, it usually works.
If they demand a full refund ask was it working when they bought it.
Say it was working when you sent it and obviously only just stopped now.
We're not talking about brand new but used and secondhand.
If you feel like you should, perhaps offer a partial refund.
But TBH I would empahasise the fact it's 2nd hand and was working when you sent.
They have to prove that it was your fault and not theirs!
It's hard cheese really, and I'd be p**sed off but that's the way it goes!
