View Full Version : Biker down - Thor involved in an accident today
Got this from Thor, for some reason he can't get on the forum and is keen for some advice:
Had an off today on my way to work, was filtering through on the right hand side of the traffic and a car pulled out on me to do a U-turn, no chance of stopping, hit his wing, flew off the bike and broke my collar bone on impact with the tarmac.
Got up and walk to pavement and sat down, driver called police and ambulance – the paramedics took me to st mary’s. Got checked out x-rayed etc, the whole thing was very quick, everything else ok apart from the shoulder.
Now am home lying on the sofa and have been given painkillers and also was told not to move my arm. Was riding my scooter, recovery truck says the front wheel is pushed back into the radiator, forks bent, fairings smashed etc given its age and condition, I don’t think it will be rolling ever.
Police said accident division will get in touch with me. I have the driver’s details and the producer but no other details. Not sure whether to contact the driver yet. I seem to remember similar occurrences written here in the past, what is the likely outcome in terms of insurance etc not spoken to the insurance company yet. What is the best way to proceed? Being looked after by wonderful fiancé, looks like I’m going to be off work for a bit.

Call the insurance com immediatly and inform them of the accident, then take it from there. Much the same that happened with me.

Firstly, no way should he contact the driver directly. He should go through his insurers who will appoint a solicitor [or he can choose one himself if hes not happy with the appointed one] and they will deal with the third partys insurers.
Secondly, it sounds like another time my letter could be useful. Bearing in mind mine was a rewrite from the original where someone did a u turn without looking. He won his case hence passing it on to me and I won mine on that basis too.

I second (third, or even fourth!) the advice to contact his insurance company and then follow their lead.

Firstly, INFORM THE INSURANCE COMPANY! Really important to get them in the loop.
Secondly, (and this is just conjecture: I was a courier back in the mists of time and have had loads of this type of crash, but can't remember the outcome of all of them) I believe that Thor is probably 70% in the right, as he's just travelling in the correct direction in the road, and overtaking on the right hand side rather than the left. It is the driver doing the turn in the roads obligation to ensure that his manouvre will not affect any other traffic. That said (and here's where the 70% comes in) it could be argued that because Thor was filtering the other driver may not have seen him (Was Thor weaving, or simply overtaking a stream of traffic?)
Thirdly, get well soon, and make sure the bone is set properly. I shattered my collarbone in the same way about 10 years ago, and it still sometimes gives me gyp (Damn I sound old!)
I saw a green scooter somewhere around a couple of days ago with damage that sounds just like this. Hope it's not too killer to get fixed mate.

Check out the link in my post above. Said letter won me my case even though I was filtering past traffic and had no witnesses. :D
You will note the highway code specifically mentions drivers do a blind spot check to avoid making a manouvre without seeing someone properly.

The letter worked for me too, giving me an uncontested County Court ruling in my favour.
We are gradually winning the argument, if you are filtering in a responsible manner you should not be held even partially liable for another drivers dangerous manouver.
The key test seems to be the standard of your own riding. A really good way of demonstrating this is to draw reference to the remarkably minor injuries that would be far more severe had your riding have been reckless of fast. When I introduced this to my statement it kind of made the other drivers claim that i was doing 80 mph through two lanes of stationary traffic look obviously flawed.
Sorry about your off though get the insurance on it don't accept any offer of blame and make them fight on your behalf, remember it is in the insurance companies interest for you to accept part blame, they can then hike your insurance.

It's not just cars. I once t-boned a chap on a CG125 who decided to u-turn out of some traffic I was filtering down the outside of. I kept it upright, he didn't. No real harm done but I was cross! Problem with bikes is they are much more manouverable than cars and now I'm always wary around bikers I don't know.

My mate had EXACTLY the same thing happen to him, SAME INJURY! :shock: , wrote his millie off, hes still has a broken collorbone (did it april 1st!) :roll:
I got the letter passed to me, fowarded it to him and HE WON his case. :D

thanks to all for the words of support - it really helps to make me feel better.
I'm up and walking around now. phones the garage - it's write off. Had I not broken anything I would have been quite pleased! That scoot was getting on a bit.
Thanks for the link to the letter. It's pretty clear that the driver failed to perform adequate observation so hopefully should be pretty cut and dry.
My work are being very supportive as is my wonderful lady. I've got an appointment with the fracture clinic next week and full bupa cover so hopefully i'll ba alright in the long run.

Ouch, broken collar bone that brings back memories:
Wake up in morning and think cool it's healed, can't feel the bones grinding together, slowly get up out of bed making sure to breath very shallow and 'click' it breaks again. :cry: took ages for mine to heal, hope you have better luck than me. :thumbsup:

So, phoned the insurance peeps:
I haven't got fully comp or legal cover so i have been given a solicitor on a no-win no fee basis. They are a motorcycle specialist firm called Bromily Holcroft. Anyone heard of them? We've not yet discussed the incident so there's no comment on my chances.
I'll be getting a stack of paperwork soon!
Otherwise holding up ok. Some tasks are hard (putting on a shirt) while some are easier than expected (drinking beer) :wink:

My son used Bromily Holcroft when he got knocked off his scooter by a bus a couple of years ago.They were very good,and handled everything including having an accident investigator in.Taking on a bus company is normally a no win situation for a private biker,but with their expert help,we won the day and got paid out.Go with it and good luck.

I think the guy your looking for is Brian Simpson in Ipswich most of the racers swear by him and i think he had something to do with getting a certain footballers broken foot better to play in the world cup.
