S.79 Environmental Protection Act 1990 as it relates to Statutory Smell Nuisance.
Local authorities are obliged to investigate all complaints received and take action if it odours interfere with another persons use or enjoyment of their premises. The owner will have a defence if he can show that he is using best practical means to control the odours, i.e. install and maintain his extraction system.
Seems reasonable to me. Why should a fish and chip shop be treated differently to any other takeaway or restaurant?
Another non-story from the BBC. Would they have run the story if the complaint was about a curry house? Seems to me that they should have researched their story before running it as this is very routine work for local authorities.

That's rubbish IMHO
Of course that's what the smell is - but the complaint is that it smells enough for someone to complain.
As Jabba said if it's kept clean enough you shouldn't smell it from outside.
It's like a fishmongers shouldn't smell of fish - because that smell is rotting fish, which they shouldn't be selling.

You might not think like that if you lived near to, or directly above, one and the extraction system wasn't being maintained or had broken.

In an ideal world, yes but the bottom line is that a well-maintained extraction system with new carbon filters will 75-85% efficient at best. There will always be some residual odour emitted, and more as time goes by. Generally, this is dispersed to atmosphere at high level through a vertical flue but under adverse weather conditions this can come to ground close to the premises before its dispersed.
It is this residual odour that causes the problems, especially with spicy foods like currys, etc, and why we get way more complaints about odours from curry houses than fish & chip shops. Probably in the ratio of about 100:1.
We routinely object to planning applications for hot food premises where there is residential accommodation nearby because we cannot guarantee that there will not be a problem for residents.
I can understand why someone would complain if things weren't as they should be. I'm in Court next week prosecuting a pub landlord because he is being recalcitrant about dealing with a problem he's causing. The main complaint relates to fish & chip odour at lunchtimes.

Yes, but like I said, they are comparatively rare. It is true that they don't attract the same level of complaint as say a curry house, but complaints are received.
There may be reasons other than the lack of odour which could explain why people don't complaint about 'em, of course. But that is a different matter and one that I will not be drawn into on a public forum.

in the good old days this is what would have happened
the person complaining would have gone into the chip shop & said this shops a bit smelly
then the chippy would have said yeah sorry about that ...here have a FREE bag of chips
complaining person take chips & go home
everyones a winner :wink:
but now there will be a full investergation by the council ...which will lead to the shop being closed down the chippy bloke will be out of work & forced into selling drugs...then the goverment will state that you can only have a chippy on top of a mountin as not to offend peeps noses :roll:

Since the law goes back to the Public Health Acts from the start of the 20th Century, exactly what do you class as the good old days?
I don't recall having closed any food premises on odour grounds during the last 15 years, except where they've opened without planning consent (and usually inadequate extraction) and have caused a problem from day 1.
As for "a full investigation", if you read the BBC article there's no suggestion that the local authority has done anything other than "have a quiet word" to ask the guy to check his extraction system. That will have taken no more than a 5 minute phone call. There's no reference to notices or prosecution or even a visit having been made. Like I said, routine daily work and no cause for such a fuss.
Do you think it unreasonable for him to have been reminded to do something that he's been obliged to do since opening his shop? It's not as if he's being treated differently to any other chip shop owner.
The present law has been about in one form or another for decades. Its nothing new - just one of those things that's been going on quietly behind the scenes since probably before your parents were born. One of those things that the Council does that people don't hear about because its not a big issue. Unless something goes wrong, of course.
I can't see the big deal in that and I'm surprised that you can. I'm more surprised that the BBC think this important enough to merit a page on their website.

ok, lets clear this up,
the smell of fish, is not the fish rotting, this contributes to the smell, but it is not,
the smell of fish is the oils burning in the oil that its cooked in, this is normally what happens when you fry something in an open fryer,
extractor fans, are designed to extract oil and heat from the air, nothing else.
you can keep a fish and chip shop spotless, and it will still smell of fish and chips, just as a pub smells of alcohol, and KFC smells of chicken.
ok ok so I may have been a touch string in my comments.
Well if its not within limits then yes it should be looked at but generally speaking I was a little shocked at the story.

Yes you did, well i used to get that complaint anyway and i was running a chippy up until 2000
you can keep a fish and chip shop spotless, and it will still smell of fish and chips, just as a pub smells of alcohol, and KFC smells of chicken.
Which is why the extracted air is passed through odour control units before being vented to atmosphere at high level to help minimise the impact on people living nearby and why, following a complaint, the council officers asked the owners the check that his system was working okay.
This is a huge non-story and not the first from Auntie Beeb this week.
