Well now i can say i have done it! 18 years old, boy racer stamp on my head, passed my test 2 months ago, dropped her Wednesday night at 18.30 :cry: Following some old bloke, he was doing 20 in a 30 and was starting to get on my tits(I know composure is the key to a good rider) and i decided i would look left and get round him on the left hand side aka undertake! As i have turned back to look and see if I can make it past before the next junction, the geezer has decided that he's turning right to a side road at the last minute and stops dead indicator on very late with me still doing 30 mph and approaching his rear bumper pretty quickly. Natural reaction front brake, not the best idea and looking back i think i could've maneuvered around him :( So me and my pillion skittle down the road towards his car. The next thing i remember is turning over looking across the floor for my pillion who has managed to get up and off the road quickly enough. There's me with the tank crushing my ankle, i get it off and out the road. Go through all the rubbish and details with the other driver while we are doing this i look around his car for damage and guess what jack shizzle wrong with his car :evil: :roll: So there i am scrapes and cracks to the fairing in need of a new bracket for the gear shifter and a new indicator and some confidence to ride again, there he is complaining of blooming whiplash where there was clearly no damage to his car. But there was a good thing that came out of it all, I have the experience been and done now and also the emergency services were very helpful.

Anyone had damage like this before if so what charges am i looking at?

P.S. I know u've heard it all before but i still believe that it still wasn't my fault because he stopped too early and didn't give enough notice of indication, i know if i was to appeal it being my fault my age and experience would come into play.

don't think age and experience will matter, its the fact you tried to undertake him, thats what'll get ya.

as long as you learn from your mistake and no harm came to you or anybody else is the main thing...

Sorry to hear about this.

Unfortunately, you hit the vehicle in front of you, so the liability is automatically with you. However, this may be weighted & not 100% liability. I reckon you'll be lucky to get a 50/50.

It's also possible to get whiplash without damage to the vehicle, so there is a chance, but then again, he's probably playing on it for the PI claim, a reflection of the way the world is at the moment.

Chalk it down to experience ;)

Lucky you 2 weren't damaged. Did your bike actually hit his car? Maybe that he saw your bike in his mirror, panicked and stopped dead - I've known it happen :roll:

You know what not to do next time. I'm not being judgemental, I've done it myself, only when I did it I couldn't walk away from it :oops:

It happens mate. I dropped my SV 3 weeks after buying it. It wasn't the end of the world. However mine was solely my fault as I screwed up in the wet on a tight right hander. A new gear lever is around £40. The indicators can be changed cheaply and it depends how badly the fairing is damaged and if it's fully faired or half faired.

Also, don't undertake :P

Theres an impact point on the fairing just above the headlight which i think i may have hit his exhaust

Baph is right, you hit him so it's your fault. Drivers like that really do vex me and they always come out in force on Sundays when i'm trying to practice the bends quicker going to Boxhill. How the bloody hell am i supposed to practice whilst doing minus 20 MPH?!!!! Rant over....please carry on
Glad you're ok though! You need to have an 'off' early on in biking life to give you more respect for the road. There are some riders who have never come off and ride like hooligans cos they think they're invincible. Not true. They'll just come off harder and faster when they eventually do unfortunately :cry: . (Not aimed at anyone in particular btw)

probably he will make an insurance claim, which will put your premium up renewall, but thats about it.

Your probably fuming right now but don't let it pi*s you off, it's made me a better rider and alot more alert; on the plus side you've probably learnt a valuable lesson.

The important thing is you and your pillion are ok.

If there was no damage to old git's car I'd tell him to poke it and see him in court.Even deny making contact with his car if there is no evidence or witnesses.

Really sorry here about ur off, that just sucks, hopefully your bike will be fixed quickly.

Did the police show, if so did they report it and were you being told you were being reported for an offence? they would have filled in yellow book(well its is down here) if was gonna reported as PI accident.

Was there any impact damage to the car? If not then injury so no whip lass, I had some trying that one on me. Turned up on blues, one of the drivers calimed being injured, looked over both cars no impact damage or even sigh of one, so wasn't reported.

Its not just you, I smashed my first car up after passing less than 3 months before hand, it happens somtimes, espically as a new driver /rider. Take Care mate.

I'm sure we've all done it, got annoyed at someone, wanted to get past, made a snap judgment and done something we shouldn't have...I know I have...but I think in this case (from how it reads to me) it'd be better if you looked at what you did wrong so you don't do it again. Doddering fool or not, sounds like completely your fault to me.

1. I can't think of a single 30 zone where there'd be enough space to perform a safe undertake. It's not the motorway after all. How were you planning to do it?

2. IMO making any dodgy move is up to you to decide but especially not clever when carrying a pillion. Not lecturing here, just know from my own experience (and I have carried many pillions for many miles) that I would be mortified if anything happened to anyone other than me.

3. You say when you turned around to face forwards again you were doing 30, though you'd already said he was doing 20. In other words, going 10mph faster than a vehicle you're following and then taking your attention off them to look behind = recipe for disaster.

I'm sure his lack of early indication and sudden braking were factors, but I'd agree with whoever said to take it on the chin and learn from it, rather than absolving yourself from responsibility.

Indeed this is right! I had my off on Mud and diesel... Lucky that was before the SV so it wasnt such a loss on y old crap £350 bike :rolleyes:.

Glad you and the pillion are good! Hate these shaddy gits who try to pull that crap! Wimps in cages! How much momentum can a bike have compaired to a car with brakes on!? :evil:

GL with that mate. Get on the bike again asap and get some confidence back, just be careful and keep your distance, oh and try to keep off of the front brake when wet/wintery! Thats my 2Cents ;)

Oh how is the pillion? Will he/she be back on the bike with you?

nothing ever happened, all it was was go your own way to fix, hence being owner of the blue n whitey.
