Well, I've had an interesting week bike-wise. Got hit by a car on Sunday afternoon while out on a ride with a mate. Filtered to the front of some traffic lights near the Meadows in Camberely, lights go green I start to pull off when a Ford KA decideds to jump the lights and hits my left leg and starts to push me across the lanes. At this point I look at the driver who swerves the other way and then apologises.................I mean is it me but how do you not see a bright green and very loud bike!? He never stopped but then the bike was not damaged but my leg was a bit sore. I guess I could have made him stop but was just thankful hat I was still upright.
Then on Tuesday morning just coming out of my road on the Hornet, enter a roundabout just after the Ely to head towards the M3 when a car decides that they do not need to give way to traffic ont he right (or on the roundabout). At this point I am half way on the roundabout, I can see he is not going to stop in time so I start to brake. Car is stil steaming along so I emergency brake and lose it on some gravel. Bike goes down and lands on me. Luckily I was doign about 15 mph at this point so just have a minor scratch to engine casing and handlebar ends are scuffed. My right knee now hurts like a swine and my Roof helmet is well and truly ruined. Car mananged to stop eventually, although I have to say there was so much gravel on that roundabout even he skidded right past the roundabout. Turns out he was uninsured too (borrowed his mum's car for interview as his had broken down that morning). As I am relatively unhurt and bike is almost totally fine I decided to give the young kid a break. Told him how stupid he was and he could have killed me but demand that he covers the cost of new jacket and Arai helmet. I have all his details so if he messes me about I will be calling the plod.
So I've got two sore knees but a shiny new Arai helmet. A good outcome considering!:rolleyes:
Bad luck buddy, but I'd get the top of the line lid if I was you!

Thanks peeps, I got myself a nice Aria Chaser yesterday, Unbelievable difference from my Roof and my cheap Caberg. Cost £325 but asked for £20 off (why not eh?!) and got it!

It's the camoflague black and grey one. Looks quite smart me thinks. Has got so many vents! I shall show everyone my helmet later.............ooerr!:rolleyes:

btw, looks i may have to ride stinky II to the pub as eviltwin is feeling a little delicate after a mammouth drinking session last night/this morning. really hope it doesn't rain (or i'll have to wear my rather fetching waterproofs).

I REALLY was, but then I thought I change my bikes so often that it's safer to with black/grey! :p

Have you actually got the money out of the kid? otherwise it could be difficult to prove at a later time that he was even on the road let alone had anything to do wwith you. But I'm sure you would say you have your methods :twisted:

My mate Scott said the same thing. He saw it all from behind (ooer). In fact I think the only damage is to the car from my slider being as he bumped with me some force..........oh **** not again!:rolleyes: I'm half expecting the driver to report me.

That's the good thing about Arai's - their cheapest is advertised as being as safe as their most expensive (not sure if that extends all the way to the Hamster tested one?)

Should have got the cops involved.
I dont care why he was driving uninsured, he shouldn't have been on the road.
What if he had taken you out and you lost a leg?
What about if when the swelling goes down you find your knee doesn't work as well as it did.
Will be hard enough to get compensation from the Uninsured Drivers Board (or whatever they are called)
If you have come to a private agreement then you can forget about it.
Doesn't matter who it is or for what reason - uninsured is uninsured.

Agreed, but from my experience of unisured drivers the law seems unbothered about them anyway. A slap on the wrist, they loose the licene in harsh cases (if they had one to begin with) and off they go. A friend of mine was hit by an uninsured rider, he broke his toe and wrote off his new gixxer 750. This was in 2003. He is still awaiting any compensation for injury and he has lost 5 years NCB AND the accident goes against him as the insurance company could not recover the loss of the bike. What happened to the uninsured rider? Well he was a soldier so he got £300 fine and 6 points. Big fecking deal! Not only was his bike not taxed, MOT'd or insured but the rear tyre was also bald. So all in all my mate came off worse even though he was fully legal and did nowt wrong. What's the point for a grazed knee, slighlty scuffed bike and broken helmet? The law makes it easy for these people to get away with it. If my leg falls off in the next 6 months I have a witness at the scene who saw the lot.

Meanwhile he has 6 months to get 2 mates together to say that he was elsewhere at the time...........
Also (but I am not sure on this - Ed where are you :P ), I believe that your "gentlemans agreement" with him could prejudice any legal issue on this.

Perhaps you are correct mate. And thinking back maybe I should have got the Rozza's involved but he was quite young, inexperienced and scared sh*tless at the time. He's also paid me most of the money I've asked for so even now I've made some out of the ordeal but yes I was very lucky really. Just hope it doesn't happen again, these things happen in three's they tell me! Anyways, thanks for the well wishes, but it takes more than 2 suicidal drivers to get me off the road..........:smt041

Unfortunately I think you found a couple of the homicidal ones!
From what you've said above, I think you took the right route the second time, but the first one not stopping should of had you making them stop. (look at Thumper21 thinking her bike was OK but had structural damage)

Yeah, am a bit worried as he might try to get me for the scratches to his car. There must be scratches. That said, he made the mistake not me. It's weird, usually this stuff would really get me angry but I was so calm, almost horizontal about it all. Very strange, maybe age calms you down..............but then I've been out riding with you Stu and I know that ain't true! :p

Bloody hell- the rainy weather really does bring out the idiot in road users, doesn't it?
Glad that only scratches were suffered all round and much respect for your calm and reasonable behaviour.
Hey Dan - bad luck. Gglad it is sorted and the 2nd one stopped. Its always a hard one to prove anything if you didnt actually hit him and there are no witnesses. So you've done well to get anything out of him at all considering if the insurance comps had got involved it wouldnt have been so easy. If it was me my only concern with this option was if he would continue driving under the same circumstances and if it turned out worse - in the end would prob make the same decision as you though and hope for the best.
Blooming eck Dan, didn't know about this till last night, sounds like some mucho bad luck you've been having. Glad you and your bikes are relatively unhurt and maybe get that knee checked out if its giving you pain.

Yeah might do, when I get my kneedown it REALLY hurts now......:rolleyes:
Sorry to hear about your crash, glad your ok.
Always get the police involved in a personal injury accident especially if the little scum bag is not insured. Don't forget that you have to report a personal injury accident to the police within 24 hours, that's both parties. You can't decide to leave it for a couple of weeks and then report because you didn't get your 'gentlmens agreement' you arranged at the side of the road, doesn't work like that. Even if you're not to balme but are involved and you did'nt report you can get stuck on for failing to report an accident. On this occasion seems like he'll keep his gob shut as he was uninsured and won't want to make anything of it, he can't make a claim through his insurance company as he doesn't have one - remember, always report!

I do see what you're saying but as I never hit him (although he failed to give way causing the accident) I felt that nothing could really be gained from reporting it. Other than getting his licence revoked for no insuracne (only been driving 8 months), and while he was to blame it was a bit of a dodgy situation as there was so much gravel on the roundabout. Had there been no gravel I probably would not have fallen off in the first place. Anyway, all sorted now, he's paid me for the damages to my kit and he's in the dog house for borrowing his mum's car without her knowledge. I think he learnt his lesson that day.
All's well that ends well ! :thumleft:
