The very nice (as in nice looking, even my mum said he was cute-pity hes married) traffic officer came to see me tonight to take my statement etc....


Im smiling......




Shes admitted FULL blame and the 3 witness's agree i was noooo way at fault/shes to blame-im actually close to tears, just pure relief!!

He asked if I wanted to prosecute her...and ive said NO, it was a accident, think shes learnt a hard enough lesson plus i dont want this dragging out further and longer than it has to be, although ive said i dont want to take it further he said its up to the accident investigation etc if they want to due her for driving with undue care and attention because im injured!

I'll find out next week if sv is to be written off or not-im suprised if shes not!
if she is, well then the hunts on for a new bike!!

Glad to hear it! At least there will be no issues with her insurer. If there are, just put them in contact with the Traffic lad.
He may put her on a Driver Improvement Scheme as an alternative to prosecution. Again, a good thing 'cos education is often better than the big stick approach.
Hope you heal fast and well, certainly, you look well enough in your avatar!

What a relief for you.... but then if she hit you from behind then she would be to blame anyway. I would be claiming for my injuries too :).

I knew i wasnt to blame, but was dreading her saying i suddenly stopped etc...just glad shes gone "yes i was at fault" BIG BIG relief all round here, i know its gonna take ages for payment for injuried but HOPEFULLY bike claim wont take so long now!

then imo I'd go for

675, Gixxer750 (these two are interchangable depending on mood) then SVthou.

But then I won't fit on a 675 so I'd personally have to rule it out and go for the Gixxer. Buy a Gixxer and let me have a go, pleeeease! with a cherry on top! ;)

This is different, is doesnt run :D serioulsly though hope you,re feeling better soon, if I was in your shoes I d go for a GSXR 750 but me legs are too short so its an SV for me for a while, until me legs lengthen obviously ;)

If it goes anything like when I had my accident, expect a letter in about 3 to 6 months saying they are not proceeding due to lack of evidence. I suspect even if I'd pushed for a conviction (was a bit hard pyscologically, the lass who hit me was sat next to me in the ambulance when the Police asked if I wanted to go ahead with it) nothing would have happened.

Get well soon, just remember to milk the whole "I'm Broken" thing with your man!

I got took out in Reading in 87 or 88 by a lady driver who pulled out on me at the last minute abd left me nowhere to go, except the side of her car, then the roof, the bonnet, the ground then I found myself under the car as she panicked and ran onto me, then she reversed off me dragging me about 20 feet backwards before dumping me and clearing off. Fortunately I had dozens of witnesses so was ok , a chap chased her down and brought her back and the police and ambulance were called, the thing was she panicked and when I met her later she was so genuinely distraught that I decided not to prosecute her cos I actaually felt sorry for her, so good for you for giving her a break, nobodys perfect after all

dont need to milk it, he knows how much pain ive been in-he was waiting for me (total suprise and a very welcome one)when i came home from hospital and stayed the night with me, basically he rocks, as do all my mates :D

cheers huni, like i said it was a ACCIDENT!, she stopped, she stayed with me, she stayed very calm and manage to get me to calm down enough to get my parents phone number and very calmly call them and explain what had just happened, i know she went into shock shortly afterwards.Lessons have been learnt, im still here, still breathing and still SMILING.

A prosecution against her will put the rubber stamp on any personal injury claim you may want to make against her. As it is she still has a get-out in that she hasn't been prosecuted for anything and so may be seen as having not been 100% to blame.

Personally, I'd prosecute purely to ensure a claim against her for personal injury and uninsured losses will go through unhindered. I'm not a vindictive sort, so I wouldn't do it just to put points on her licence or make her suffer in any way, and I hate the litigious culture that has taken this country over, but there's times when people must pay for their mistakes. Compensation for a broken leg caused by someone else's stupidity is fair game.

ive got legal cover via my insurance so they are handeling any personal injury claims etc hence why i see no point to prosecute.

I am off work and will be for AT LEAST the next 5 weeks, im slowly going mad i tell ya! all ive got is my laptop and phone, sky is upstairs and i cant quite manage stairs yet!

thast how i would look at it, i mean i'd be fumin that i had broke me leg and mashed me bike...BUT...if the car driver showed that they was sorry, and showed concern, not you know i didnt see you, you bikers are a menace, etc then i wouldnt prosecute, admitting blame and an apology would be enough for me too.:D good on ya paws!

Yeah, I'm another one who agrees with ya Paws ... good on ya for not prolonging this woman's suffering too ... now if only there were MORE people like you!

I rolled (in the car) into the back of another motorist on the M5 last year. Basically the car was on a slight slope and started rolling forwards. I was momentarily distracted by my stupid bloody SatNav telling me for the umpteenth time that I needed the exit in 2 miles (why do they continue to tell you even when it must be obvious that you're not moving?! are did I just buy a cheap one?! :-P ) ... anyway rolled into the back of this guy at < 1mph ... we both eventually made it to the hard shoulder (through the jams), and I said, "Look, there's no damage to your vehicle, but if you should find there is, then here's my number, give me a call, and I'll sort it out ... I'd rather not go through my insurance thanks, but if you need a new bumper, then I'll pay for it. Sorry mate".

Bloke seemed ok with this and thanked me for stopping etc.

Next thing I hear, my insurance company have paid out over £3,500 in repairs and personal injury claims (driver claimed whiplash).

So much for being "nice" about it ... f*cking ar$ehole :smt097

Would I have done the same in his position? NO I WOULDN'T!

So ... Well done to you Paws :) Nice to see/hear that there ARE still some decent people in this world ;-)

Hope the leg's better soon and what a bummer about not riding again this year :(

Personally, I'd have the gixer ;-) but then if I did, I'd be in much the same state as you, only it would be my own fault :D LOL

Strewth....That isn't really the same thing is it?
Running someone over twice because your panicking then s*dding off and leaving them does seem to question whether you should be behind a wheel...


I'm not in anyway advocating throwing away the key but a temporary loss of license/ more training/ and even a first aid course couldn't be a bad thing?

Though I suppose prosecuting doesn't give you any say in the outcome. & a court case seems a bit unnecessary.

+1 for the "good for you" Paws ... GWS & at least the weather's rubbish..

Hmm. Personally I would've prosecuted. In fact I did about 3 years ago and the guy lost his licence. He pulled out in front of me as he says he didn't see me on a bright yellow VFR with lights on a beautiful June summers day!

Sure, she might not have meant to knock you off but there are so many dumb drivers out there that perhaps she needs to learn the lesson that the law will not tolerate this kind of lazy and dangerous driving. I feel that a 10 year refresher test should be introduced to keep us all focused on how to drive/ride correctly. People's driving standards need to improve to make us all safer. Afterall, if you'd hit a car you can bet your tattoos that would throw everything at you. You seem far too nice for your own good Miss Paws. It still shocks me how bad people's driving/riding is everyday. Anyway, hope you don't go too mad and GWS! ;)

Surely it would only go to court if she denied any charges against her. Even if it did go to court you probably would have little involvement yourself. When Eviltwin got hit by a car ages ago the driver got done for dangerous driving and he didn't have to speak or go to court at all.

They havent, i had a choice of if I wanted to take further action, which i dont,the cps MIGHT take it further themselves though.

Please accept my belated 'OUCH! Hope you're okay', not been concentrating at my usual levels (which isn't high at the best of times):bigsmurf:

I'd go with LouLou, when I had my accident I had no choice over whether the third party got done or not, it was Essex Police who nicked her, and the CPS who bought prosecution. (although they did me for due care as well - no case though).
Although it's easy to say what I would have done, I was not there, and I'm not the one who's now in a world of pain......
.... What I would say is this though: She may have not meant it, she may be a really nice person, but that does not make her the best driver in the world. If by prosecuting her she gets the chance to attend a DIS instead of standing before the beak, then I would say that it would be a good thing. Time spent on additional training is never wasted, even if it is to refresh what you learnt 2, 5, or 20 years ago.

I cannot have a pop at anyone for their views after they've had an off (esp if it was someone else's fault), as I remember what (and still does) went through my mind, I'm just glad you're going to get back on that horse!

Just so you all know, to qualify for a DIS, the driver has to accept they were at fault, there be no other offences apart from the due care and a full evidential file be in place should the driver either fail the course or fail to attend. Then, they will be summonsed for the due care.
