Yeah right it's a coincidence. I wouldn't believe it for a second, but like I said, I don't think that constitutes plagiarism.

It doesn't both me 28 songs on the album one or two are gonna sound like someone else's.
What is Plagiarism is surely what Crazytown did launched a whole carrer off one rift from Pretty Little Ditty off the Mothers Milk album.

This sounds robbed to me.
I remember reading somewhere that they are big Tom Petty fans, so they obviously know the track well.

What blows me away though is that they BLATANTLY robbed a Clapton riff on one of their albums. Painfully obvious stuff.

TBH, there are lots of riff robbed off lots of people. I have heard dEUS riffs in all sorts of places, also Captain Beefheart, also tons of lifted Burt Jansch riffs turn up in tracks. A lot of the time, since these guys (Jansch) are subtle, might only use the riff once or twice in the whole track, never use it again, people dont pick up on it it seems.
I mean, music is not my business... but, often its an open and close case I feel like.

Another interesting thing to look for is this beat. I wonder how much the guys how put this down made??? NAda.

Based on my knowledge of copyrights, I'm reasonably sure that any copyright case would be fairly futile. It's a common practice in music that time signtures, riffs etc are regularly copied and this causes no problems.
On the other hand, I'd be willing to admit that my knowledge of copyrights and general IP is very restricted to the software industry and pretty limited in that area.

From my knowledge of image copyright (I may be wrong so please no one take my word for it!) - I understand that you can't copyright ideas or styles - only the finished creation (I imagine in music this would also apply otherwise there would only be one blues tune, one jazz tune, one country and western tune etc!!)

If an image has been inspired from another image from what I understand it must quite different - enough so as not to infringe - I spose whether it is different enough is a subjective opinion - (the judges opinion in the end I spose!)

I assume the same goes for music although I often wonder how it works with sampling? do they have to get permission there or is it because the overall creation is so different they are ok? I spose only a lawyer specialising in Intellectual Property Rights would know the real answers!

Samples need permission, because they are a direct copy of the artists work.
Songs get alot more leeway before it would be classed as infringement.

Covers are also another issue, and while a writer may charge royalties, once a version is publicly released, then he cannot stop others from covering that song.
