4 months old is brand new, if it was years old then you might be in a bad position. But I don't see how they can expect to get you less than the money you paid for the items?

If you don't still have the receipts (naughty girl) then go to a retailer and get a quite for the items you wear. Hopefully as they're so new they'll all still be available, which will just be further proof of their newness.

i'm going to look into that, but it just doesn't seem right that the person who tries to squish me doesn't have to make right what he broke:(

All your kit is essentially safety related equipement and you should not therefore be expected to replace it with used stuff when you don't know it's history.
You could also argue that any used clothing is not acceptable and reasonably demand new replacements.When BB junior was taken out by a bus we claimed for new jacket,lid,gloves,boots and trousers,and they paid up on the basis of new J&S prices.The big hit comes when they value your bike at used prices,and you have to accept some nominal guide price for that which is always low.Stick to your guns on the kit issue,and put in a small but reasonable claim for any injury,including pain and bruising.You should get a few hundred quid for that to make up for the derisory vehicle value.

Ok, ok, not the Picasso (it would have clashed terribly), but you get my drift?

Also, if the driver at fault, or his insurance company kick up a fuss, why not request that he has an eye test. I did this for my big accident and I found the 3rd party much more amenable.

Going by the pics the wrinkly who pulled out looks like he last had an eye test shortly after he was conscripted for the trenches…

thanks for that, you have really cheered me up. i will have a rant at the solicitor tomorrow.

the bike is only 4 months old too so fingers crossed we'll be able to get a new one to replace it.

interesting thought about the eye test, i may suggest that to the solicitor

AAaaaaaaaaaaaaaand,

He was wearing glasses. You have to declare to the DVLA if you need glasses when driving, otherwise you're license is in jeopardy. I can guarantee that he won’t have done that. That will mean he was driving illegally and his insurance could be invalid.

If his licence was invalid, therefore insurance void, you have a guilty party & the board for uninsured drivers to get recompense from.

I'm sure plod would like a chat assuming that his eye-sight was bad (and he knew about it), hadn't informed DVLA & wasn't wearing specs.

Out of court settlement anyone?

NO!

If he has an insurance policy, they HAVE to pay up, regardless of whether he's made it void through not wearing the correct glasses.

If this is the case then the insurance company will the sue him to get their money back, if they choose to.

Either way, don't worry. If you want to apply leverage by being awkward and asking for an eye test, you can.
