I am not taking any sides here mind you.

I worked in retail for 7 years and I have heard some real fairy tales when customers gave their version of events! I almost felt like having a dictaphone on me at all times! On the otherside I once had dealings with TIME computers who in my opinion were nothing short of criminal.

I am just really curious about this and I would be more inclined to pay more to get a bike from a dealer now that I know you have such an amazing amount of come back even on a 7500 mile old chain! Frankly I find that quite trippy!

I would certainly want to get certain things from the dealer in writing or even record the conversation though. Christ if this chain business is anything to go by I am surprised all dealers don't have mics in the shop! I guess it tells you something that they don't do this. We all know how many lies they tell so I guess they know that you win some and lose them and in their case they win more than they lose!

ok its expected that you will do the daily checks but if somethings faulty then if its under their warranty they should fix it. I had problems starting my SV - they replaced the battery. Then it went again in blackwall tunnel and packed up 10 yards out of it... faulty rectifier. the guys i bought from did it under their warranty they supplied, no quibbles.

what you have to remember here is that its 3 weeks after the bike was bought. if it were just lack of adjustment it woulnt have needed new sprockets which were also replaced. a case of the chain on its last legs Id suggest in which case it would have been prudent of the dealer to replace it.

I've had experience of this motorcycle warehouse place. When I was getting new tyres for my SV a guy comes in on a knackered Kwak GPZ500, with mismatched, wrong sized tyres. The tyre guy told him that not only was the front illegal, as it was the wrong sort, but the rear was dangerous as it was massively oversized and rubbing on the swingarm, and to top it off the combination of tyres (think one was crossply and one was radial) was illegal. Guy was a born again and had no idea and was gutted, cue having to get it all sorted and on the phone to them with much the same "not fit for purpose" complaint.

Tyre guy wasn't impressed - not only was the bike really hard to handle with the massively oversized rear, he made it clear that the guy had been lucky to get there wihtout being slung off and injured...

Please don't have any sympathy for the dealer. For the record. The bike was sold, and I have the original advert from their website.. 'In showroom condition'. There was no heated discussion. I actually emailed him a few days before the phone call explaning the chain had come off and I was prepared to buy the new chain and sprockets ( because I know he would be in his rights to put the cheapest replacements on ), all I wanted was a cheque for £45 to cover labour !!

The phone call was not heated..... he hung up on me after abusing me before I had chance to get the call heated. I know it is my word against his but I would swear on my own life this is true.

You don't have to feel sorry for the dealer, or put his side.

This specific case has been decided in court - and the dealer was guilty.
Well done Ash - I hope that the money side gets sorted out quickly, and that the new Divi owner contacts you so you can point him to the court also.

The sooner he gets put out of business, the better.

The chain didn't break though did it so how could you say it was definitely faulty.

That the sprockets were changed does not necessarily mean they were worn. Could have been damage caused when the chain came off.

Yeah right , like the courts get it right all the time :roll: . Maybe the nail was hit with a mallet.
