nah she wasnt reversing she was going forwards i hit round where the wheel arch is n tbh the car got off v.lightly compared to my bike. brothers taken some pics of the area for me and he says "if you are pulling out of that drive then you should see a bike as u can see down the footpath" seems shes trying to claim that she got waved out as her defense

So she's trying to claim she was taking instructions from some other road user instead of looking where she was going? That's as good as pleading guilty.

With regards to the family jewels, I recall someone posting his
swollen (humongous!) bits on our forum a few years ago. The good
news is that, as far as I recall, the swelling eventually went away
and functionality was restored.

That won't work, even if you are waved/flashed out it is still your duty to make sure the path is clear.

I agree. At least this is what I recall my driving instructor telling me many years ago.

Had a similar situation in a work van, outside lane of a dual carriageway in london coming up to a set of lights and a car in the left hand lane flashed a car out of a side turn (in the daytime so I couldn't see he'd flashed his lights) as I was just passing him, and the car drove straight out into the side of the van. I (in my opinion) did nothing wrong, but I think the insurance called it a 50/50 claim, because the bloke in the left hand lane made a statement to say that he had signalled to the car to come out (despite the fact that I had no way of seeing that he had flashed his lights). Therefore it seems to be the case that if you have witnesses then you stand a better chance.
