level is measured with bike upright

Shouldn't be over full when upright. Somewhere in between when upright not on rear paddock stand either.

ok, its just such a huge difference considering the lean angle on the side stand. will overfill damage the bike?

Officially yes, damaging gaskets and oil seals however alot of people tend to go with a little more is better than not enough.

Too much can also be as bad as not enough. If it was me I would undo the sump plug and let a bit out when upright so it sits just under the full mark.

That way you know your safe :)

If it was me and it was overfilled, i wouldnt touch the sump. No doubt half the oil will spill out, just syringe it from the top will be easier and less messy.

I always check the level on rear paddock stand. I haven't found another way that isn't a faff ...

The bike needs to have its oil level checked with both wheels level and the bike upright.

If the bike's on the side stand you put quite a bit more oil in than you should.

If you use a rear paddock stand and no front stand the motor's tilted forwards, you'll under fill with oil.
