Insurance claim for kit
 
I was involved in a bike accident last friday and my leathers, gloves and helmet are now unwearable. My solicitor has told me that I cannot claim for replacement of these items but just the second hand value at the time of the accident.

Has anyone else had this experience? How is the second-hand value determined?

Complete & utter tosh IMO (please note, I've not claimed for anything on insurance, ever).

Say to the solicitor that thats fine, and ask him how you go about sueing the driver for the cost of replacing your damaged property?

that's the point, she's told me that i can only claim/sue for the second hand value from the third party. :(

her exact words are:
"Please note that you are only able to recover the cost of any item of clothing equal to its second-hand value at the time of the accident, and not the replacement of new items"

Unfortunately you can't expect new for old for all your kit, insurance only works that way if specifically specified as such with appropriate premiums.

Helmets are not clothing, they are legally required safety equipment.

but i'm not trying to claim from my insurance, it's part of the recovery of losses from the third party.
:( this reallly sucks, my stuff's only 4 months old, i wonder how much it has devalued in that time??

so does that mean i should be able to recover the full cost of replacing the helmet then? this is all so confusing and annoying.

How about your home contents insurance which IS usually new for old - unspecified personal possesions while out of the house section.
