Not entirely no. If you're moving, you have to make sure it's safe to do so (as per, look, signal, move). The pedestrian was crossing the road, and had to make sure it was safe to do so, instead of relying on a car driver to do that for them.
In a round about way, I was trying to express what BillyC said, but I think he'll be lucky to get 50/50.

I was just pointing out in the example given the pedestrian would represent the car that pulled out, you seemed to compare the pedestrian with the biker.
I fully accept that filtering/overtaking (although he was overtaking not filtering) is a hazourdous activity and you should be prepared to accept responsibility if there's an accident and you are to blame.
Can I ask how the different ratios of blame would help you. I understand for your own damages but if you have a 90:10 in your favour you would still lose your NCB?
