I worked for a council handling the paperwork for Public Liability claims for pothole damage to vehicles. The official depth of a pothole that affect a councils liability is, from memory, 70mm. Any damage to a vehicle from a pothole exceeding that depth can be the subject of a Public Liability claim on the council. The council is legally obliged to keep records of all pothole notifications as evidence in the event of a claim. So the council responsible should make sure potholes like this are repaired asap but not all do. A few years ago, Stockport Council paid out over £5 million in claims in a year because they thought it was cheaper to pay out the claims than to repair the roads.
