Default Questions about claims

Some of you might have read some drivel about a crash I had in february 08, well before I had chance to send my condemning letter to them (thanks luckypants) I got a letter saying they've decided to deal with my claim in full but on a without prejudice basis (******s) so that means I'm still paying a sky high premium on everything...so I sent the condemning letter for good measure.

Well anyway they paid me for bike repairs ( )months ago, they've also agreed to pay all my travel expenses I incurred. But they've offered less than the clothing cost for the damaged clothing and it was all in mint condition. Annoyingly I sent my receipts to them so I don't know how much it was anymore (£250 rings a bell) and they've offered £200. Does anyone know how much I am entitled to? Can I just say fine then either pay the full amount or pay for the gear I replaced it with (£900 rrp)? I know it's 'only' like £50 but they've been absolutely shocking in the handling of this so I want everything I can from them...plus I don't think £50 is pocket change.

Also does anyone know what I should get for my personal injury or know what's done about it? I had a sprain in my hand (I know I'm a little girl) but it genuinely still hurts sometimes when I shake hands with people, 'muscle trauma' in my shoulders and upper back and whiplash.

I have had quite a few dealings with all this following my two big accidents. You won't get the full value of your clothing, it depreciates with age and in some circumstances they can state that it would off needed replacing sometime soon anyway. I had a two year old RX7 when I had my smash in 2004, I won't get the full retail price of £450.

This varies, how it has effected your ability to work, look after yourself, and future problems which you may get (arthritis is not included in that prediction) for a start.

Cheers Dave, **** I should have plagiarised the age of the clothing.couple of weeks of work and aches and pains every so often to this day. Uncomfortable originally though.

You don't get any money for pain, apparently the law believes all pain can be treated with medication.

Sustain an injury, pain is not an injury it is the effect of an injury.

Breaking your Femur once is painful, breaking it twice is even more painful but no more money as it is still a broken limb section (they don't count the breaks).

Oh right I thought you meant 'you've broke your femur but it only hurt and didn't affect you otherwise therefore you ain't getting moneys'.

I broke all but a couple of ribs against the pillar of the car and punctured a lung. Unfortunately I landed on the bonnet of another car and broke my right shoulder (the socket, ball and blade). The impact from the left followed by the landing on the right shattered my pelvis into thirteen pieces.

I had a big accident 3 years earlier when I got hit from the side and run over, this buggered my right leg up a bit also (it is now the favoured/strongest leg despite its injuries).

I still have a limp, as you might guess, and every now and again the ankle plays me up. However, I commute to work everyday on my SV650S and I still blast around on the SV800S whenever I want.

I hope you do heal soon mate, it does take along time for even some of the simplest breaks to heal, but you need to make sure you life style is right. No smoking, very limited on the drinking, and exercise! I should never have survived that last big one, ever consultant i have met has said the same. I lost way to much blood, and my internal organs were all over the place. I am a Orthopaedic and Neurological case study, the human body can take a lot of abuse, but more importantly in can bounce back just as good.

It's infuriating isn't it. I've lost a lot money on insurance (I'm 18 )because of the not admitting liability. I got a quote for £300 on the SV the ncb (because of them not admitting liability even though they'd paid out for the bike) never came through so the company cancelled my insurance and charged me £70 admin fees and I had to got to bikesure who were £470 but said they'd refund me £100 if it turns out not to be my fault.

Insurance companies will screw you over as much as they can, they like money coming in not money going out.
