So I'm stopped at red lights with a speed camera I pass every day not 5 meters from the lights, me about to to right about 10 meters just after the camera for a car park where my journey ends.
Lights turn, I start to pull away but get no power, twitch the throttle a little and check gears, still dying, so I start to pull in the clutch ready to spool some power and let the clutch out (it's an OLLLLD Trident so i get dead spots in the throttle response sometimes, not mechanical enough to fix it), as I clutch in that has the unexpected effect of sending the bike accelerating forward at a good pace (felt like it started "Gripping" as I clutched in if that makes sense) and I set the camera off, speedo showing about 34. I didn't want to dump the throttle back out or grab brakes (been riding too long to still think that's a good idea and I'll be damned if I'm gonig to risk binning the bike because of a camera) so I just rolled off throttle, slowly let out clutch and started breaking, I could have avoided the flash if I had slammed the anchors on as soon as it started accelerating but didn't want to risk dumping the bike and opted for a controlled decelleration instead to get control back. If I DO get a ticket for this, can I appeal on mechanical grounds? ![]() |

fill out the nip wizard (its on the site somewhere) and post it to a shiny new thread. There are qualified lawyers on there as well as police and laypeeps with a reasonable knowledge of the law. Don't for fluffs sake appeal on mechanical grounds, you'll get done for driving an unroadworthy vehicle. Take the better advice from pepipoo. |

If I were you I would not appeal on mechanical grounds.
What you are saying is that there is a fault with your vehicle which means you are not totally in control of its speed at times. AND, knowing this and still using it would leave you open to further prosecution. Mind you, it's your call at the end of the day. |

Heh that did cross my mind but It passed it's MOT not 2 months ago and the throttle response hasn't been an issue before, just a minor annoyance, however after this it's going straight back to the garage!

An MOT is pretty much only valid until the vehicle leaves the test centre.
All it does is state that the vehicle passed the relevent tests at the time of the test. TBH, imo it's bollox but I suppose it keeps wrecks of the road. |

If it's a gatso there's a good chance there was no film in it.
Also if your speedo was showing 34, on a curvy you were only doing 32ish and on a pointy you were doing less than 31mph. On both bikes the speedo's overread, so if you do get a ticket ask to see both photos and calculate your speed using the road markings (which is how they would have to prove the accuracy of a Gatso). If you've been done at 32mph complain, you shouldn't be watching the speedo that closely on safety grounds, you should we watching the road ahead.
