I get what the judge is trying to say about not sending a message that disproportionate voilence will be tolerated, but have they not just sent a bigger message that criminals can break into your home and the owners won't do squat for fear of being jailed? IMO -if you break into someone's home and threaten/tie-up their family -if you walk out alive you should consider yourself fortunate.

It's the same as the Tony Martin case, the burgler was leaving the premises when attacked. IMHO this is 'worse' than the Tony Martin case, because the victims of the robbery gave him a sustained beating. Now having said that, I do not agree with either case resulting in jail for someone giving a thieving git a good kicking for threatening their lives and robbing them.
I hope the reason the thief was spared jail is he is now crippled from the beating, it's what folk like him deserve. |

There's a difference between whacking a thief round the back of the head whilst on the premises in the act of taking property and chasing a thief down the road to knock seven different type of poo out of him with a cricket bat post event.
The law allows you to use reasonable force to protect your property. It doesn't allow you to deliver summary justice. Having said that, I fear I would do the same in those circumstances ![]() |

Having been robbed a number of times I can tell you that it's all well and good to say that you should of been more restrained but It's terrifying enough having someone in your house with you at the best of times not knowing who they are, how many of them, what they are armed with or how they will react to you and what they will do to your family.
Having them tie up your family at knife point I imagine peacful rational thought pretty much goes out the window and I know for a fact I would of happily killed that man given half a chance if he threatened my wife and daughter in my own home... I mean robbery is one thing..and yes if he was just in their house and they did this I'd say it was justified to send him away for a bit although still harsh. But as his familly was tied up and their lives threatened...personally I'd shake the mans hand. The judge needs to appreciate that his man would in no way be in his right mind after an ordeal like that and if you have to chase him down you biggest fear is he gets away and comes back, when you aren't home, or with friends....you do what you feel at the time you need to make sure it never happens again. By law a householder is not allowed to make ANY preperations for fighting off intruders, that's pre-meditated. The Criminals however can plan ahead, bring whatever weapons and as many people as they want, all the fear and uncertinty is by law and nature on the Victims side, the criminals and the law should not be supprised when a victim pushed to this emotional extreme retaliates with extreme emotion, most likely violence. And if you think brain damage will stop this idiot's life of crime I doubt it, I'm sure he'll be back at it in no time. Last edited by PsychoCannon; 15-12-09 at 12:06 PM. |

i agree that you should be allowed to defend your own home, in fact in the article the judge agrees that you are allowed to use a reasonable ammount of force. however what the 2 have been sent prison for is basically attacking the criminal they caught. by the sounds of things they had caught the burglar then went to town on him with a hockey stick, baseball bat and a bit of pipe. the burglar ended up with a fractured skull. now surely the 2 men could have held this criminal until the police arrived, but it seems they just wanted to beat the crap out of him.

The real issue here is the lack of confidence in the system to deal with violent criminals like this bloke.(I mean the intruder!)While we are happy to send people to prison for driving too fast while failing to protect the public from people like this who break in,attack,and threaten to kill normally law abiding folk,we will get overreaction from victims.And who wouldnt do that in the circumstances?

Hah yeah my neighbour over the road has 3 staffi's and they are gorgeous friendly dogs but my GOD I wouldn't like to be the poor B*****d who breaks into THAT house, the male (Zeus) has a hinge jaw where his head just splits in half to show a very POWERFUL jaw of teeth that he's trained to use on command

I think that's a reasonable (if not expected) reaction towards someone who has threatened the lives of your family within your own home. A slap on the wrist is all he deserves at most.
