My solicitor has sent me a letter with the value of the offer she says the 3rd party insurers have made for personal injury ( see pic below taken over a week after the hit ) from my filtering accident last year. At £2350, it’s slightly more than she estimated they would offer and she has recommended acceptance. Her letter details what could happen if I reject it, ie possible retraction of offer and potential court cost etc, but I’m not convinced it’s a good offer. The specialist I saw ( appointed by the other insurance ) says the swelling and slight discolouration that remains will be gone by a year ( June ) and that I may have a slightly dropped arch. That sounds a bit permanent to me and could require specialist inserts in my footwear to prevent back problems. On the other hand, I’m not having any real trouble from my foot and am training in the gym as normal. They have paid fully for lost overtime, new boots and other small costs incurred.
I’m going to ring her today to discuss and ask her to send out the original offer letter which I have not seen. Do you think I should accept the offer ? Thanks Ratty

Its all down to you.
Do you think its an acceptable offer? If its more than you were expecting in the first place then thats a bonus in itself. Long term, nobody can tell you how you will be in the future with respect to walking/pain etc. Its not as if you have lost a limb and it will have serious effects on your lifestyle. Some on here will tell you to take it, some will say to wait for more money.. Its your choice in the end ![]() |

Do not accept, I got over £6000 for a "soft tissue" shoulder injury 6 years ago. Tell you what I would give £20,000 to stop it hurting. They said everything then would clear up in a couple of months.
when where you offed? if you have plenty of time before you need to take it to court, give it time to settle down or prove the meds wrong. The other sides meds have a vested interest. Get your own specialist report.

I know nothing about personal injury... but it sounds low.
Ask her whether this is the figure in Kemp (book on personal injury and up to date award levels). |

Seems oddly low to me when (faked) whiplash seems to get you quite a bit more. Have to weigh up whether your solicitor will need substantially more fees to try and recover you a bigger payout, net result might not be worth the hassle.
For what it's worth, dropped arches will give you gip for quite a while but eventually you should be fine with that aspect of the injury. Both my feet are as flat as a pankcake and have been since my early teens. |

Thanks for the answers guys.
I believe they all refer to the same bible when looking up the figure so that must be the Kemp book Ed refers to. I think the consultant referred to it as the 'Green Book'. I rang quite late today and got no answer so I dropped her an email with my thoughts. I’ll see what answers she offers to my key points. To be honest, I’ve been disappointed with her whole performance. Slow to keep me up-dated and usually only after prompting. Twice I’ve asked her for reports, to be told “I’ve sent that out… I’ll send it again”. She generally seems to be batting for the other side (ooh err). “I wish I’d gone with a no win no fee type”, but she was appointed by DAS so she will get her whack what-ever happens. Has anybody heard of offers being retracted after a first refusal? Thanks Ratty

I've been offered £1K for basically no injury at all that was clear in 2 weeks - so sounds low.
